Eminent Domain and Impositions. As of the date hereof, there are no existing, or to the best of the City’s knowledge, proposed eminent domain proceedings of any Governmental Authority affecting any of the property in the Project Site, except a proposal to possibly extend Academy Street north from its intersection with Chapel Street to ▇▇▇▇▇▇▇ Street to tie the Proposed Project into the POKO project, so-called. As of the date hereof, the City has not initiated or proposed any eminent domain proceedings that currently affect any portion of the Project Site. Except as contemplated by this Agreement with respect to the Waypointe SSD, as of the date hereof, the City has no currently pending or planned public improvements that will result in any charge being levied or assessed against, or will result in the creation of a lien upon, any land within the Project Site. As of the date hereof, the City has not made any assessments for public improvements against any portion of the Project Site that are not of record, including, without limitation, those for construction of sewer and water lines and ▇▇▇▇▇, ▇▇▇▇▇▇ ▇▇▇▇▇▇, ▇▇▇▇▇▇▇, sidewalks and curbs.
