End User Terms. The terms of use presented to each Authorised User at the time of their initial log in into the Application, which is available on the Acolyte website and which may be amended at any time by the Company. Fees Means the charges as set out in the Order Form or any Change Notice. Good Industry Practice Means the use of standards, practices, methods and procedures conforming to Data Protection Legislation and the exercise of that degree of skill, care, diligence, prudence and foresight which would reasonably and ordinarily be expected from a skilled and experienced person engaged in the provision of similar services to an entity of a similar size and nature as Acolyte under the same or similar circumstances. Initial Term The initial term of this Agreement as set out in the Order Form. Insight Report A report created by ▇▇▇▇▇▇▇ and made available to all Clients through the Application, on topics of general interest relating to aspects of the labour market. Intellectual Property Rights Means all trade secrets, patents and patent applications, trademarks and service marks (whether registered or unregistered and including any goodwill acquired in such trademarks and service marks), trade names, business names, internet domain names, e-mail address names, copyrights (including rights in computer software, object code and source code), moral rights, database rights, design rights, rights in know- how, rights in confidential information, rights in inventions (whether patentable or not) and all other intellectual property and proprietary rights (whether registered or unregistered, and any application for the foregoing), and all other equivalent or similar rights which may subsist anywhere in the world. Intelligence Report A report which is commissioned by the Client into an aspect of its staffing needs or staffing challenges, or an aspect of the job market as a whole.
