Common use of Enforcement of the Note Clause in Contracts

Enforcement of the Note. Nothing herein contained shall affect or impair First Union's right, which is absolute and unconditional, to enforce the payment of the Note; provided, however, that First Union may not enforce, or demand enforcement of, any rights or liens with respect to the Collateral except upon the terms and conditions stated elsewhere in this Agreement and the Loan Documents.
