Enforcing Our Rights. You agree to pay all our costs, including attorneys’ fees, in enforcing our rights under this Agreement.
Enforcing Our Rights. We may enforce our rights to be paid the total balance due by you, by: (1) Suing you for what you owe; or (2) Enter, without notice or demand, with or without legal process, any premises where the property is located and take possession of the property. We have the right to sell the property in accordance with law at private or public sale or auction upon such terms and manner as we may see fit and we have the right to bid and purchase the property. Proceeds on disposition of the property will be distributed in accordance with the PPSA. If there is a balance still owing to us after we have sold the property and subtracted the total amount you owe us plus all our costs, you must pay us the deficiency; or (3) Taking such other action as we see fit; or (4) Exercising, in addition to any other rights and remedies provided by law, the rights and remedies of a secured party under the PPSA.
Enforcing Our Rights. We may delay enforcing our rights under this Agreement and may accept late payments, partial payments and payments marked as “paid in full” or containing similar wording without losing any rights that we have under this Agreement or by law, including the right to recover in full all amounts that you owe us on the Credit Card Account.
Enforcing Our Rights a. If you default in any obligation under this mortgage we can enter on your property at any time, without the permission of any person, and make all essential arrangements that we consider necessary to inspect, lease, collect rents, manage your property, repair, put in order or complete the construction of any building on your property. We may also enforce any of the following remedies: i. ▇▇▇ you – We may take such action as is necessary to collect the unpaid balance of the loan amount, the interest that is due and payable and our expenses. ii. Foreclosure and sale of your property – We may take court proceedings to foreclose and sell your property. We may ask a court to order the sale of your property. If the court makes such order, it will supervise the sale proceedings. The net proceeds of the sale will be used to pay our expenses, the interest that is due and payable and the unpaid balance of the loan amount. Any balance remaining after all claims have been satisfied will be paid to you. If the amount we receive from the sale of your property is less than what you owe us, plus our expenses, you must pay us the difference. iii. Other – We may take any other remedy available to us under the law. iv. Appoint a Receiver - We may appoint a Receiver as described in “APPOINTING A RECEIVER”, as set out herein. b. Our expenses – You will pay all our expenses of enforcing our rights. Our expenses include, but are not limited to, our costs of taking or keeping possession of your property, an allowance for the time and service of our employees utilized in so doing, our legal fees on a lawyer and own client basis and all other costs related to protecting our interest under this mortgage. All our expenses are immediately payable by you. Until paid, our expenses will be added to the loan amount and will be a charge against your property. Interest is payable by you on our expenses at the interest rate payable on the loan amount until our expenses are paid to us in full. These expenses can be deducted from the net proceeds of any sale or lease of your property. If the net proceeds from the sale or lease do not cover our expenses, you must pay us the difference immediately. c. Judgments – If we obtain court judgment against you for your failure to comply with any of your obligations to us under this mortgage, the judgment will not result in a merger of the terms of the judgment with our other remedies or rights to enforce your other obligations under this mortgage.   • Our rights not prejudiced Our rights and remedies shall not be determined, affected or prejudiced by, and the total outstanding balance shall immediately become due and payable in the event of your bankruptcy, insanity, death or other legal disability, and you or your representative shall be bound to immediately return to us the card cut in half, and pay the total outstanding balance in full (including all liabilities incurred by you or notified to us after such occurrence of any of the foregoing events).

  • Our Rights You acknowledge that We are not obligated to use Your Contribution as part of the Material and may decide to include any Contribution We consider appropriate.

  • Your Rights & Obligations You have represented fairly and accurately, to the best of your abilities, all details pertaining to the consigned item. In tandem with Collectable, you may elect to retain equity ownership in asset(s) consigned to Collectable’s platform.

  • Third parties rights The Contract does not give rise to any rights under the Contracts (Rights of Third Parties) Act 1999 to enforce any term of the Contract.

  • Enforcement of Rights Borrowers are jointly and severally liable for the Obligations and Bank may proceed against one or more of the Borrowers to enforce the Obligations without waiving its right to proceed against any of the other Borrowers.
