Common use of Engineer’s Certification Clause in Contracts

Engineer’s Certification. Before the payment by the District as provided above, the Developer shall provide the District with a certificate, signed by the District Engineer, certifying that: (i) the amount to be paid to the Developer is equal to the lesser of the fair market or the actual cost of the Improvements and (ii) the Improvements are in substantial conformity with the plans and specifications and all applicable laws governing the installation or construction thereof as certified to the Developer and the District by the District Engineer.

Engineer’s Certification. Before the any payment by the District as provided in paragraph 5 above, the Developer District shall provide obtain from the District with Engineer a certificate, signed by the District Engineer, certifying that: (i) the amount to be paid to the Developer is equal to the lesser of the fair market value or the actual cost of the Improvements portion of the Project being acquired and (ii) the Improvements are portion of the Project being acquired is in substantial conformity with the plans and specifications and all applicable laws governing the installation or construction thereof as certified to the Developer and the District by the District Engineer.
