Enrollment When Applicants Exceed Capacity. If the number of applicants for admission exceeds the capacity stated in this Contract for any grade, pupils shall be selected for attendance based on a random selection process, as required by Section 504(3) of the Code, except as provided below. The PSA must annually submit to the DPS Designee a copy of the procedures to be used to select students when applicants for enrollment exceed capacity. The PSA must allow any pupil who was enrolled in the PSA in the immediately preceding school year to enroll in the PSA in the appropriate grade unless the appropriate grade is not offered at the PSA. The PSA may give enrollment priority to the sibling(s) of a pupil enrolled at the PSA.

The State may terminate for default if the Contractor fails to cure a breach of this provision no later than thirty (30) days after being notified by the State.
