Common use of Entirety; Amendments Clause in Contracts

Entirety; Amendments. This Agreement, including any exhibits and schedules attached hereto and referenced herein, constitutes the full understanding of the Parties and is the final and complete expression of their agreement with respect to the specific subject matter hereof. The terms of the January 2004 Agreement continue in force and are not affected by this Agreement. No terms, conditions, understandings or agreements purporting to modify, vary, or supplement the terms of this Agreement shall be binding unless it is hereafter made in writing and signed by each of the Parties. No modification to this Agreement shall be effected by the acknowledgment or acceptance of any purchase order or shipping instruction forms or similar documents containing terms or conditions at variance with or in addition to those set forth herein.
