Common use of Environmental and Engineering Reports Clause in Contracts

Environmental and Engineering Reports. Buyer has provided to Seller copies of all engineering and environmental reports, studies, investigations, sampling results and other similar documents in Buyer’s possession or within Buyer’s reasonable control relating to Buyer’s due diligence investigation of the Leased Real Property and the improvements and operating assets located thereon (but excluding any such items provided by Seller or Parent to Buyer).

Buyer has provided delivered to Seller copies of all engineering and environmental reports, studies, investigations, sampling results and other similar documents in Buyer’s the possession of Buyer or any of its Affiliates or within Buyer’s the reasonable control of Buyer or any of its Affiliates relating to Buyer’s due diligence investigation of the Leased Real Property Properties and the improvements and operating assets located thereon (thereon, but excluding any such items provided by Seller or Parent to Buyer).
