Common use of Environmental and Social Performance Clause in Contracts

Environmental and Social Performance. Unless MCC and the Government agree otherwise in writing, the Government shall ensure that all Projects and Activities undertaken, funded or otherwise supported in whole or in part (directly or indirectly) by MCC Funding under the Compact comply with the MCC Environmental Guidelines, including the environmental and social performance standards set forth in the Performance Standards on Environmental and Social Sustainability of the International Finance Corporation (as in effect from time to time, the “IFC Performance Standards”) that have been incorporated by reference into the MCC Environmental Guidelines. The Government shall also ensure that the Projects and Activities comply with all national environmental laws and regulations, licenses and permits, except to the extent such compliance would be inconsistent with the Compact. Where there is a difference between national environmental laws and regulations and the standards required by the Compact, the Government shall ensure that the stricter standard is followed provided it remains in compliance with the Compact. Unless MCC agrees otherwise in writing, the Government shall fund all necessary costs of environmental and social mitigation measures (including, without limitation, costs of resettlement) not specifically provided for, or that exceed the amount of MCC Funding or the Government Contribution specifically allocated for such costs, in the Detailed Financial Plan for any Project or Activity.
