Common use of Environmental Management System (EMS Clause in Contracts

Environmental Management System (EMS. The EMS shall be the overarching system by which the Developer shall cause environmental commitments made during the Environmental Approval and permitting processes, and other Environmental Requirements to be carried forward and reflected, as appropriate, in the design and implemented throughout the Work. Developer shall utilize the EMS to track on-going issues, identify environmental compliances, non-compliances and identify actions required/taken to correct any such non- compliance.
