Equipment Malfunction. We are responsible to the account holder for any loss caused by the failure of equipment to complete a transaction that was accepted in accordance with your instructions. However, if you were aware or should have been aware that the equipment was unavailable for use or malfunctioning, our responsibility will be limited to correcting errors in the account and refunding any charges or fees imposed as a result. You are solely responsible for your own personal computer anti-virus and PC security measures, and those of any authorised user, to help prevent unauthorised access via ANZ Internet Banking to your transactions and linked accounts.
Equipment Malfunction. If the Supplier's representative discovers that the Equipment is defective or is malfunctioning or has failed or is not otherwise in Good Working Order during the course of the Routine Maintenance the representative will use all reasonable endeavours to repair it during that visit at the Location. If that is not reasonably practicable (or it is not reasonably practicable to do so during Business Hours) the Supplier's representative shall either arrange for a further visit to the Location within Business Hours to complete the repair, or arrange for the removal of the Equipment (or part of the Equipment, if applicable) for repair off- site (a “Non-Routine Repair”). The Supplier shall be entitled to charge and the Client shall pay for any Non-Routine Repair in accordance with clauses 3.4 and 4.
Equipment Malfunction. Please report any items of disrepair or malfunction of equipment or appliances to the owner and we will have them repaired as soon as possible. There is no refund of rental for mechanical failure on any of the equipment.
Equipment Malfunction. 13.1 If the Equipment is involved in an accident, becomes unsafe or unfit for use, malfunctions, or requires repair, Lessee must immediately stop using the Equipment and immediately notify ▇▇▇▇▇▇▇▇▇▇▇. 13.2 If the condition described in Section 13.1 is the result of normal operation and otherwise in accordance with this Agreement, ▇▇▇▇▇▇▇▇▇▇▇ will repair or replace the Equipment (at its sole option) with reasonably similar equipment, if such replacement is available. 13.3 If ▇▇▇▇▇▇▇▇▇▇▇ elects to repair the Equipment, it will use reasonable diligence to make the repairs on demand. If any work is done outside of ▇▇▇▇▇▇▇▇▇▇▇’▇ regular hours, by reason of which ▇▇▇▇▇▇▇▇▇▇▇ is required to pay double time or other overtime charges to its employees, or to anyone doing the work for Lessee, all such charges will be paid by ▇▇▇▇▇▇ to ▇▇▇▇▇▇▇▇▇▇▇. 13.4 In the event of accident or breakage of any part of the Equipment, and after receiving written approval from ▇▇▇▇▇▇▇▇▇▇▇, Lessee may have the same repaired by any competent person, firm, or corporation at its own expense. 13.5 ▇▇▇▇▇▇▇▇▇▇▇ has no obligation to repair or replace Equipment rendered inoperable by misuse, abuse, neglect, or failure to adhere to any obligations of this Agreement. Lessee must pay ▇▇▇▇▇▇▇▇▇▇▇ for any such repairs or related damage. 13.6 ▇▇▇▇▇▇’s sole remedy for any failure or defect in Equipment is to terminate any rental charges accruing after the time of failure. Lessee must return the Equipment to the Store Location within twenty-four (24) hours from the time of defect in order to terminate rental charges. 13.7 ▇▇▇▇▇▇▇▇▇▇▇ will not be liable in any event to the Lessee for any loss, delay, or damage of any kind or character resulting from defects in or deficiency of the Equipment or accidental breakage thereof.

Equipment Malfunction. Dominica Beach, LLC will endeavor to address any equipment malfunction promptly on behalf of Owner (such as televisions, DVD, microwaves, refrigerators, dishwashers, air conditioner, etc.) Guest will not, however, be entitled to any refunds as a result of any malfunction of such equipment - even if repair or replacement is not available.
Equipment Malfunction. SMB takes great pride in the appearance and maintenance of its equipment. SMB will arrive at Customer’s place of business with equipment in good operating condition, clean and ready to bottle. In the event of an equipment malfunction, SMB will make every effort to repair such equipment on-site and resume bottling. If repair of the equipment is not possible, SMB will deduct such down time for crew labor from the contract price and reschedule bottling to a convenient date for both parties. Equipment Malfunction. From the Effective Date and ending on July 1, 1997, notwithstanding any other term of this Agreement, if as a result of any malfunction of the coating and converting equipment at the Facility occurring within six (6) months after the Effective Date SKC is unable to meet its supply obligations hereunder, SKC shall at its own expense exercise commercially reasonable best efforts to repair such malfunction promptly but such failure shall not constitute a default by SKC under this Agreement unless such equipment malfunction was the direct result of the gross negligence or willful misconduct of SKC.
Equipment Malfunction. If the Equipment malfunctions during its intended use, Key 2 Communications Inc., at its sole discretion, will maintain and replace the Equipment if necessary. In such an event, you agree that Key 2 Communications Inc.'s liability and Your sole remedy is limited to a refund of charges or replacement by Key 2 Communications Inc. of such Equipment, provided that You notify Key 2 Communications Inc. immediately upon such malfunction.
Equipment Malfunction. Retailer agrees to immediately notify EBT Provider by telephone of any Equipment failure or malfunction relating to the EBT Program and to make Retailer’s premises available for repairs or replacement. Repairs or replacement are to be completed within 48 hours of notification. In the event that the Equipment fails to operate, EBT Provider will make provisions to retrieve the Equipment which may be done on-site or at EBT Providers discretion; EBT Provider may ship replacement Equipment by express carrier to Retailer for Retailer installation. In either instance the expense of returning the Equipment will be at no cost to the Retailer.
