Common use of Essential Employee Clause in Contracts

Essential Employee. An employee who has been designated as vital to the operation of the University, whose presence is required regardless of the existence of an emergency condition, and whose absence from duty could endanger the safety and well being of the campus population and/or physical plant shall be designated as an "essential employee." Essential employees are defined as those employees working in the following classifications: Automotive Services Helper HVAC Technician Automotive Mechanic Laboratory Assistant Automotive Services Mechanic Laboratory Helper Automotive Services Technician Landscape Technician Cabinetmaker Licensed Practice Nurse ▇▇▇▇▇▇▇▇▇ Locksmith Driver Maintenance Aides Electrician Maintenance Mechanic Electrician Helper Motor Equipment Operator Engineer Technician Painter Engineering Assistant Plumber Groundskeeper Police Communications Operator Groundskeeper Lead Police Communications Operator Lead Housekeeper Service Worker Housekeeper Lead Stationary Engineer HT and HP HVAC Mechanic Steamfitter In emergency conditions, the University has the obligation to communicate, via its website, code-a-phone, work phone, if possible, and mass media the decision to close the University. We will endeavor to communicate as soon as possible. Essential employees are required to report to work during their regularly scheduled work hours, even if the University is closed, unless otherwise notified. If there are extenuating circumstances, an essential employee may, at the reasonable discretion of their supervisor, be excused from reporting during an emergency. If notified, essential employees may be required to report for duty or return to duty during non-scheduled work time. If an essential employee fails to report for duty, the employee may be subject to disciplinary action and will not be paid for that day. If a designated government official who has the authority to close the roads to non-emergency vehicles due to emergency conditions lawfully closes all the roads within the jurisdiction, employees who live within the jurisdiction where the roads are lawfully closed or who must travel through an area where all the roads are lawfully closed to get to the University shall not be disciplined for not reporting to work during the time of a lawful closure.
