Estimations Clause Samples
The Estimations clause defines how projected figures, such as costs, timelines, or quantities, are provided and treated within an agreement. Typically, it clarifies that any numbers or schedules given in advance are approximate and not binding, and may be subject to change as more information becomes available or as circumstances evolve. This clause helps manage expectations between parties by making clear that estimates are not guarantees, thereby reducing disputes over variances between initial projections and actual outcomes.
Estimations. If the amounts, as described in Paragraph 3 above, cannot be determined by the dates described in Paragraph 4 above, on an exact basis, such payments will be paid in accordance with a mutually agreed upon formula which will approximate the actual payments. Adjustments will then be made to reflect actual amounts when they become available.
Estimations. If the amounts required in Paragraph 3 above cannot be determined by the dates described in Paragraph 4 above, on an exact basis, such amounts shall be estimated in accordance with reasonable actuarial methods that shall approximate the actual amounts. Adjustments to payments based upon such estimates shall then be made to reflect actual amounts when such amounts become available.
Estimations. The Rottnest Island Authority will calculate electricity consumption charges based on an estimate of the Customer’s usage where:
(a) An electricity meter is shown by test to be recording inaccurately;
(b) An electricity meter ceases to register; or
(c) Access to the electricity meter is prevented. This estimate will be based on:
(a) The amount of electricity used during the same period in the previous year;
(b) If the Customer does not have a prior billing history, the average usage of comparable customers;
(c) The Customer’s reading of the meter; or
(d) A test of the meter.
Estimations. If the amounts, as defined in Paragraph 3 above and Schedule B, cannot be determined by the dates described in Paragraph 4 above, on an exact basis, settlements into the trust accounts will be paid in accordance with a mutually agreed upon formula which will approximate the actual settlements. Adjustments will then be made to reflect actual amounts when they become available. The Ceding Company will provide written notice to the Reinsurer as soon as reasonably practicable if the amounts described in Paragraph 3 above cannot be determined by the date of the [REDACTED] Accounting Report.
Estimations. (a) Where circumstances prevent an accurate Meter reading, the Responsible Person may estimate electricity consumption and demand at a Connection Point. The Responsible Person must use a basis of estimation set out in the Metering Rules or generally accepted in the electricity industry.
(b) Where possible, EnergyAustralia must reconcile Charges based on an estimation of electricity consumption with electricity consumption recorded by the next available Meter reading. An appropriate adjustment must be made in the Customer's next invoice.
Estimations. If the amounts, as defined in Paragraph 3 above and Schedule B, cannot be determined by the dates described in Paragraph 3 above, on an exact basis, settlements will be paid in accordance with a mutually agreed upon formula which will approximate the actual settlements. Adjustments will then be made to reflect actual amounts when they become available. Ceding Company will provide written notice to the Reinsurer as soon as reasonably practicable if the amounts described in Paragraph 3 cannot be determined by the date of the Quarterly Accounting Report.
Estimations. Client’s “estimated” Federal Student Loan Repayment amounts given by SLF and its authorized Service Advisors are estimations based in part on the accuracy of information provided by the Client, as well as information received from the National Student Loan Database (NSLDS) and the U.S. Department of Education (herein to collectively be referred to as “Stated Parties”). Final repayment amounts delivered by our Processing Department may vary depending upon the final verification of information provided by all stated parties. False or inaccurate statements, regarding the aforementioned information, proved to SLF by stated parties, does not constitute a valid refund request if after completion of contracted services if the Client is not satisfied with the new repayment.
Estimations. If the actual amounts required in Paragraph 4 above cannot be ----------- determined in sufficient time to prepare the applicable quarterly accounting report within the timeframe such report is due pursuant to Paragraph 4 above, such amounts shall be estimated in accordance with reasonable actuarial methods that shall approximate the actual amounts. Adjustments to payments based upon such estimates shall then be made to reflect actual amounts within one year.
Estimations. If the amounts in the Monthly Settlement Report, cannot be determined on an exact basis by the date described in Article V, Paragraph 2 above, the Net Settlement will be paid in accordance with a mutually agreed upon formula which will approximate the actual Net Settlement. Adjustments will then be made to reflect actual amounts when they become available, including a Delayed Payment Interest Penalty. The Ceding Company will provide written notice to the Reinsurer as soon as reasonably practicable if the amounts in the Monthly Settlement Report cannot be determined by the due date of such report.
Estimations. The Debtors or the Reorganized Debtors may, at any time, request the Bankruptcy Court to estimate any Claim, pursuant to section 502(c) of the Bankruptcy Code, regardless of whether the Debtors previously have objected to such Claim, and the Bankruptcy Court shall retain jurisdiction to estimate any Claim, at any time, including during litigation concerning any objection to such Claim.
