Common use of ETA Election Clause in Contracts

ETA Election. The Purchaser and the Vendor shall elect jointly under s. 167(1) of the Excise Tax Act (Canada), in the form prescribed for the purpose of that subsection, in respect of the sale and transfer of the Assets hereunder, and the Purchaser shall file such election not later than the deadline for filing its GST return for its reporting period that includes the Completion Date.

ETA Election. The Purchaser Buyer and the Vendor Seller shall elect jointly under s. subsection 167(1) of the Excise Tax Act (Canada), ) in the form prescribed for the purpose purposes of that subsection, in respect of the sale and transfer of the Assets hereunder, and the Purchaser Buyer shall file such election not later than the deadline for filing in its GST return for its reporting period that includes the Completion Closing Date.
