Common use of Ethical and Religious Directives Clause in Contracts

Ethical and Religious Directives. In the event the Agreement includes a provision limiting the services Provider will provide, the following is applicable: (a) The Provider shall provide a list to Subcontractor and/or Health Plan of the services it does not deliver due to the Ethical and Religious Directives. Subcontractor and/or Health Plan shall furnish this list to the Division of TennCare, notating those services that are TennCare covered services. This list shall be used by Subcontractor and/or Health Plan and the Division of TennCare to provide information to TennCare members about where and how the members can obtain the services that are not being delivered by the Provider due to Ethical and Religious Directives. (b) At the time of service, the Provider shall inform TennCare members of the health care options that are available to the TennCare members, but are not being provided by the Provider due to the Ethical and Religious Directives, but the Provider is not required to make specific recommendations or referrals. In addition, the Provider shall inform TennCare members that Subcontractor and/or Health Plan has additional information on providers and procedures that are covered by Division of TennCare.
