Ethical Framework. a. Members are subject to the conflict of interest provisions of the AAD and the conflict of interest provisions of the PSOA and its regulations. b. Members shall not use any information gained as a result of their appointment to or membership on the Tribunal for personal gain or benefit. A Member who has reasonable grounds to believe that he or she has a conflict of interest in a matter before the Tribunal shall disclose the nature of the conflict to the Chair at the first opportunity and shall refrain from further participation in the consideration of the matter. The Chair shall cause to be recorded in the minutes of the meeting of the Tribunal any declared conflicts of interest. c. The Chair, as the Ethics Executive for Members of the Tribunal, is responsible for ensuring that Members are informed of the ethical rules to which they are subject, including the rules on conflict of interest, political activity and protected disclosure of wrongdoing that apply to the Tribunal. d. The Deputy Minister, as the Ethics Executive for Ministry staff assigned to support the Tribunal, is responsible for ensuring that staff are informed of the ethical rules to which they are subject, including the rules on conflict of interest, political activity and protected disclosure of wrongdoing that apply to the Tribunal. e. The Chair will ensure that an ethics plan is developed for the Tribunal, and that the ethics plan is approved by the Conflict of Interest Commissioner.
