Common use of Exception Report Clause in Contracts

Exception Report. 32.1 If a Party fails to complete an action required of it, or to deliver or maintain the improvement required, by a Remedial Action Plan in accordance with that Remedial Action Plan and does not remedy that failure within five (5) Business Days following receipt of notice requiring it to do so, the Provider or HEE (as the case may be) may issue an Exception Report: 32.1.1 to the relevant Party’s chief executive and/or Governing Body; and/or 32.1.2 (if it reasonably believes it is appropriate to do so) to any appropriate Regulator, in order that each of them may take whatever steps they think appropriate.
