Common use of EXCESSIVE DAMAGE Clause in Contracts

EXCESSIVE DAMAGE. If the Building or Premises is damaged or destroyed to the extent that the Premises or Building cannot, in Landlord's sole judgment, be fully repaired or restored by Landlord within one hundred eighty (180) days after the date of the damage or destruction, Landlord may terminate this Lease by providing Tenant written notice of Landlord's election within sixty (60) days after the damage or destruction.
