Exchange of Information. (1) The competent authorities of the Contracting States shall exchange such information as is foreseeably relevant for carrying out the provisions of this Agreement or to the administration or enforcement of the domestic laws concerning taxes of every kind and description imposed on behalf of the Contracting States, or of their political subdivisions or local authorities, insofar as the taxation thereunder is not contrary to the Agreement. The exchange of information is not restricted by Articles 1 and 2. (4) If information is requested by a Contracting State in accordance with this Article, the other Contracting State shall use its information gathering measures to obtain the requested information, even though that other State may not need such information for its own tax purposes. The obligation contained in the preceding sentence is subject to the limitations of paragraph 3 but in no case shall such limitations be construed to permit a Contracting State to decline to supply information solely because it has no domestic interest in such information. The requesting Contracting State shall provide the following information when making a request for information to demonstrate the foreseeable relevance of the information to the request: a) the identity of the person under examination or investigation; b) description of the information sought including its nature and the form in which the requesting Contracting State wishes to receive the information from the requested Contracting State; c) the tax purpose for which the information is sought; d) grounds for believing that the information requested is held in the requested Contracting State or is in the possession or control of a person within the jurisdiction of the requested Contracting State; e) to extent known, the name and address of any person believed to be in possession of the requested information; f) a statement that the request is in conformity with the law and administrative practices of the requesting Contracting State, that if the requested information was within the jurisdiction of the requesting Contracting State then the competent authority of the requesting Contracting State would be able to obtain the information under the laws of the requesting Contracting State or in the normal course of administrative practice and that it is in conformity with this Agreement; g) a statement that the requesting Contracting State has exhausted all means available in its own territory to obtain the information, except those that would cause excessive difficulties. h) a statement that the requesting Contracting State can provide information of the same nature under its own domestic law.”. Article 12 Each of the Contracting States shall notify in writing through diplomatic channels to the other the completion of the procedures required by its law for the bringing into force of this Protocol. Exchange of Information. (1) . The competent authorities of the Contracting States shall exchange such information as is foreseeably relevant necessary for the carrying out the provisions of this Agreement or to the administration or enforcement of the domestic laws concerning taxes of every kind and description imposed on behalf of the Contracting States, States (including the provisions thereof dealing with the prevention of fiscal evasion or of their political subdivisions or local authorities, fraud) concerning taxes covered by the Agreement insofar as the taxation thereunder is not contrary to the Agreement. The exchange of information is not restricted by Articles 1 and 2. (2) Article 1. Any information received under paragraph 1 by a Contracting State shall be treated as secret in the same manner as information obtained under the domestic laws of that State and shall be disclosed only to persons or authorities (including courts and administrative bodies) concerned with involved in the assessment or collection of, the enforcement or prosecution in respect of, or the determination of appeals in relation to to, the taxes referred to in paragraph 1covered by the Agreement. Such persons or authorities shall use the information only for such purposes. They may disclose the information in public court proceedings or in judicial decisions. (3) 2. In no case shall the provisions of paragraphs paragraph 1 and 2 be construed so as to impose on a Contracting State the obligationobligation : (a) to carry out administrative measures at variance with the laws and the administrative practice of that or of the other Contracting StateState ; (b) to supply information which is not obtainable under the laws or in the normal course of the administration of that or of the other Contracting StateState ; (c) to supply information which would disclose any trade, business, industrial, commercial or professional secret or trade process, or information, the disclosure of which would be contrary to publicc public policy (ordre public). (4) 3. If information is requested by a Contracting State in accordance with the provisions of this Article, the other Contracting State shall use its information gathering measures endeavour to obtain the information to which the request relates in the same way as if its own taxation was involved notwithstanding the fact that the other State does not, at that time, need such information. If specifically requested informationby the competent authority of a Contracting State, even though the competent authority of the other Contracting State shall endeavour to provide information under this Article in the form requested, such as depositions of witnesses and copies of unedited original documents (including books, papers, statements, records, accounts or writings), to the same extent such depositions and documents can be obtained under the laws and administrative practices of that other State may not need such information for with respect to its own tax purposes. The obligation contained in the preceding sentence is subject to the limitations of paragraph 3 but in no case shall such limitations be construed to permit a Contracting State to decline to supply information solely because it has no domestic interest in such informationtaxes. (5) In no case shall the provisions of paragraph 3 be construed to permit a Contracting State to decline to supply information solely because the information is held by a bank, other financial institution, nominee or person acting in an agency or a fiduciary capacity or because it relates to ownership interests in a person.

Exchange of Information. For example, or informationif one of the States requests the other to furnish information which the first State could not obtain under its own laws and practice, the disclosure second State is not required (but is permitted) to comply with that request if its laws and practice permit it to collect such information with respect to domestic tax claims. Paragraph 3 provides that, subject to the conditions of which would be contrary to publicc policy (ordre public). (4) If information is requested by paragraphs 1 and 2, a Contracting State in accordance with this Article, will obtain information requested by the other Contracting State shall use in the same manner and to the same extent as if the tax in question were its information gathering measures to obtain the requested informationown tax, even though it may have no tax interest in the particular case to which the request relates. Further, the information shall be furnished in the form requested to the extent that other State the depositions and documents requested could be obtained under domestic law and practice with respect to domestic taxes. It is contemplated that the information exchanged under this Article may not need be on a routine basis, such information for its own as reporting on income payments made and tax purposeswithheld, or in response to specific requests. The obligation contained competent authorities may agree on the items of information to be furnished routinely. They may also agree to furnish information spontaneously which they believe to be relevant in applying the Convention or the domestic laws covered by the Convention and to develop and implement other programs of information exchange within the conditions of this Article. The competent authorities agree to inform each other of materials published in their respective Contracting States which concern the application of this Convention. Such material, including legislation, regulations, rulings or judicial decisions, is to be transmitted in the preceding sentence is subject to the limitations calendar year following that of paragraph 3 but in no case shall such limitations be construed to permit a Contracting State to decline to supply information solely because it has no domestic interest in such information. (5) In no case shall publication, or sooner if feasible. Notwithstanding the provisions of paragraph 3 Article 2 (Taxes Covered), the exchange of information provided for in this Article shall apply to all taxes imposed at the national level. Thus, for example, information may be construed exchanged with respect to permit a Contracting State to decline to supply information solely because the information is held by a bankestate, other financial institutioninheritance, nominee or person acting in an agency or a fiduciary capacity or because it relates to ownership interests in a persongift, employment, excise and sales taxes.

The competent authorities of the Contracting States shall exchange such information as is foreseeably relevant for carrying out the provisions of this Agreement Convention or to the administration or enforcement of the domestic laws concerning taxes of every kind and description covered by the Convention imposed on behalf of the Contracting States, or of their political subdivisions or local authorities, insofar as the taxation thereunder is not contrary to the AgreementConvention. In order to obtain such information, the tax authorities of the requested Contracting State, if necessary to comply with its obligations under this paragraph, shall have the power to enforce the disclosure of information covered by this paragraph, notwithstanding paragraph 3 or any contrary provisions in its domestic laws.” ARTICLE XI Paragraphs 1 and 2 of the Protocol to the Convention shall be replaced by the following paragraphs: 1. ad Article 4 2. ad Article 7 3. ad Article 10 a) Where the minimum holding period laid down in subparagraph a) of paragraph 3 of Article 10 was not met at the time of the payment of the dividend and, therefore, the tax stipulated in paragraph 2 of Article 10 was withheld at the time of the payment, and the condition of the minimum holding period is met subsequently, then the beneficial owner of the dividend shall be entitled to a refund of the tax withheld. b) It is understood for the purposes of subparagraph b) of paragraph 3 of Article 10 that a pension scheme is recognized for tax purposes when (i) contributions paid by the beneficiary to the pension scheme are deducted wholly or partly from the beneficiary’s taxable income in that State under the laws of that State; or (ii) the full amount of the contributions paid by an employer is not included in the taxable income of the beneficiary in that State under the laws of that State. It is further understood that the term “a pension fund or other similar institution providing pension schemes recognized for tax purposes” also includes any investment fund, foundation or other institution in which exclusively such pension funds or other similar institutions providing such pension schemes may invest in. 4. ad Article 12 5. ad Articles 18 and 19 6. ad Article 25 7. ad Article 26 a) It is understood that the competent authority of the requesting State shall provide the following information to the competent authority of the requested State when making a request for information under Article 26: (i) the identity of the person under examination or investigation; (ii) the period of time for which the information is requested; (iii) a statement of the information sought including its nature and the form in which the requesting State wishes to receive the information from the requested State; (iv) the tax purpose for which the information is sought; (v) to the extent known, the name and address of any person believed to be in possession of the requested information; (vi) a statement that the requesting State has pursued all means available in its own territory to obtain the information, except those that would give rise to disproportionate difficulties. b) It is understood that the standard of “foreseeable relevance” is intended to provide for exchange of information in tax matters to the widest possible extent and, at the same time, to clarify that the Contracting States are not at liberty to engage in speculative requests that have no apparent nexus to an open examination or investigation (“fishing expeditions”) or to request information that is unlikely to be relevant to the tax affairs of a given taxpayer. While subparagraph a) contains important procedural requirements that are intended to ensure that fishing expeditions do not occur, clauses (i) through (vi) of subparagraph a) nevertheless are not to be interpreted in order to frustrate effective exchange of information. c) It is understood that Article 26 of the Convention does not require the Contracting States to exchange information on an automatic or a spontaneous basis. d) It is understood that in case of an exchange of information, the administrative procedural rules regarding taxpayers’ rights provided for in the requested Contracting State remain applicable. It is further understood that this provision aims at guaranteeing the taxpayer a fair procedure and not at preventing or unduly delaying the exchange of information process. 8. It is understood for the purposes of the Convention that the competent authority of a Contracting State may, after consultation with the competent authority of the other Contracting State, deny the benefits of this Convention to any person, or with respect to any transaction, if in its opinion the granting of those benefits would constitute an abuse of the Convention.” ARTICLE XII Each of the Contracting States shall notify the other, through diplomatic channels, of the completion of the procedures required by its domestic law for the bringing into force of this Protocol. The Protocol, which shall form an integral part of the Convention, shall enter into force on the date of the later of these notifications and its provisions shall have effect for taxable periods beginning on or after 1st January in the calendar year next following that in which the Protocol enters into force.

Any information received under paragraph 1 by a Contracting State shall be treated as secret in the same manner as information obtained under the domestic laws of that State and shall be disclosed only to persons or authorities (including courts and administrative bodies) concerned with the assessment or collection of, the enforcement or prosecution in respect of, or the determination of appeals in relation to the taxes referred to in paragraph 1the first sentence. Such persons or authorities shall use the information only for such purposes. They may disclose the information in public court proceedings or in judicial decisions. (3) . In no case shall the provisions of paragraphs paragraph 1 and 2 be construed so as to impose on a Contracting State the obligation: (a) to carry out administrative measures at variance with the laws and administrative practice of that or of the other Contracting State; (b) to supply information (including documents or authenticated copies of the documents ) which is not obtainable under the laws or in the normal course of the administration of that or of the other Contracting State; (c) to supply information which would disclose any trade, business, industrial, commercial or professional secret or trade process, or information, the disclosure of which would be contrary to publicc public policy (( ordre publicpublic ). (4) . If information is requested by a Contracting State in accordance with this Article, the other Contracting State shall use its information gathering measures to obtain the requested information, even though that other State may not need such information for its own tax purposes. The obligation contained in the preceding sentence is subject to the limitations of paragraph 3 but in no case shall such limitations be construed to permit a Contracting State to decline to supply information solely because it has no domestic interest in such information. (5) . In no case shall the provisions of paragraph 3 be construed to permit a Contracting State to decline to supply information solely because the information is held by a bank, other financial institution, nominee or person acting in an agency or a fiduciary capacity or because it relates to ownership interests in a person.
