Excluded Parties List. Upon the Collateral Agent's request, for so long as the NRG Member is a Member and on or prior to the date of termination of this Guaranty in accordance with Section 10, the Guarantor shall deliver to DOE a certificate of an authorized officer of Guarantor stating that the Guarantor is not listed on the U.S. Government's Excluded Parties List System (EPLS), established pursuant to 9.404 of the Federal Acquisition Regulations.
