Common use of Exclusion for non-payment Clause in Contracts

Exclusion for non-payment. The School may exclude the Pupil by providing written notice if at any time payment of any amount is overdue, including where the Foundation refuses to accept a payment under clause 4.2. If the Pupil is excluded for a period of 28 days or more in such circumstances, he / she will be deemed withdrawn without Notice and a Term's Fees in lieu of Notice will be payable in accordance with Section 9. Exclusion in these circumstances is not a disciplinary matter and there is no right to a Governors' Review. The Foundation and / or the School may withhold any information, character references or property while any sum remains overdue where it is lawful to do so.
