Common use of Exclusions from Limitation of Liability Clause in Contracts

Exclusions from Limitation of Liability. Nothing in this Agreement will exclude or limit either Party’s liability for: (i) death or personal injury due to negligence; (ii) fraud; (iii) breach of Clause 14 (“Confidentiality”); (iv) breach of Clause 5 (“Access to the Offering and Access and Usage Restrictions”), or (v) any other matter in respect of which liability cannot lawfully be limited or excluded.

Nothing in this the Agreement will exclude or limit either Party’s liability for: (i) death or personal injury due to negligence; (ii) fraud; (iii) breach of Clause 14 16 (“Confidentiality”); (iv) breach of Clause 5 11 (“Access to the Offering and Access and Usage RestrictionsSecurity”), ) or Clause 12.3 (“Partner Indemnity”) or (v) for any other matter in respect of which liability cannot lawfully be limited or excluded.

Exclusions from Limitation of Liability. Nothing in this Agreement will exclude or limit either Party’s liability forliability: (i) for death or personal injury due to negligence; (ii) fraud; (iii) under Clause 11.13 (“Data Disclaimer; Indemnity”); (iv) for breach of Clause 14 (“Confidentiality”); (ivv) breach for violations of Clause 5 (“Access to the Offering and Access and Usage Restrictions”)a Party’s Intellectual Property Rights, or (vvi) for any other matter in respect of which liability cannot lawfully be limited or excluded.
