Exclusivity; Customer Conflicts. The Distributor acknowledges that Atossa distributes the ForeCYTE Products directly and through others in the Territory and that others have been granted rights to sell the ForeCYTE Products nationally including to Distributor Customers. If instructed to do so by Atossa, the Distributor shall refrain from promoting, marketing or distributing the ForeCYTE Products to any potential customers if Atossa is notified the Distributor that the particular customer has already purchased the ForeCYTE Products from another distributor.
