Common use of Execution of Agreements Clause in Contracts

Execution of Agreements. At the Closing Time, the Preference Warrant Agreement, the Preference Registration Rights Agreement, the Preference Warrant Registration Rights Agreement and the Certificate of Designation, each in form and substance reasonably satisfactory to the Purchaser, shall have been duly executed and delivered and shall be in full force and effect.

Execution of Agreements. At the Closing Time, the Preference Warrant Agreement, the Preference Registration Rights Agreement, the Preference Warrant Registration Rights Agreement and the Certificate of DesignationIndenture, each in form and substance reasonably satisfactory to the PurchaserInitial Purchasers, shall have been duly executed and delivered and shall be in full force and effect.
