Common use of Execution of the Project Clause in Contracts

Execution of the Project. (a) The Borrower declares its commitment to the objectives of the Project, and, to this end, shall carry out the Project through MOH with due diligence and efficiency and in conformity with appropriate administrative, financial, technical, environmental and health care practices, and shall provide, promptly as needed, the funds, facilities, services and other resources required for the Project. (b) Without limitation upon the provisions of paragraph (a) of this Section and except as the Borrower and the Bank shall otherwise agree, the Borrower, acting through MOH, shall carry out the Project in accordance with the Implementation Program set forth in Schedule 5 to this Agreement. (a) Except as the Bank shall otherwise agree, procurement of the goods, works and consultants’ services required for the Project and to be financed out of the proceeds of the Loan shall be governed by the provisions of Schedule 4 to this Agreement, as said provisions may be further elaborated in the Procurement Plan. (b) The Borrower shall update the Procurement Plan in accordance with terms of reference acceptable to the Bank, and furnish such update to the Bank not later than twelve (12) months after the date of the preceding Procurement Plan, for the Bank’s approval. Section 3.03. For the purposes of Section 9.07 of the General Conditions and without limitation thereto, the Borrower shall: (a) prepare, on the basis of guidelines acceptable to the Bank, and furnish to the Bank not later than six (6) months before the Closing Date or such later date as may be agreed for this purpose between the Borrower, acting through MOH, and the Bank, a plan for the future operation of the Project; and (b) afford the Bank a reasonable opportunity to exchange views with the Borrower on said plan.

Execution of the Project. (a) The Borrower Recipient declares its commitment to the objectives of the Project, Project as set forth in Schedule 2 to this Agreement and, to this end, shall carry out the Project through MOH with due diligence and efficiency and in conformity with appropriate administrative, financial, technical, environmental financial and health care public administration reform practices, and shall provide, promptly as needed, the funds, facilities, services and other resources required for the Project. (b) Without limitation upon the provisions of paragraph (a) of this Section and except as the Borrower Recipient and the Bank Association shall otherwise agree, the Borrower, acting through MOH, Recipient shall carry out the Project in accordance with the Implementation Program set forth in Schedule 5 4 to this Agreement. (a) Except as the Bank Association shall otherwise agree, procurement of the goods, works works, and consultants’ services required for the Project and to be financed out of the proceeds of the Loan Grant shall be governed by the provisions of Schedule 4 3 to this Agreement, as said such provisions may be further elaborated in the Procurement Plan. (b) The Borrower Recipient shall update the Procurement Plan in accordance with terms of reference guidelines acceptable to the BankAssociation, and furnish such update to the Bank Association not later than twelve (12) months after the date of the preceding Procurement Plan, for the BankAssociation’s approval. Section 3.03. For the purposes of Section 9.07 9.06 of the General Conditions and without limitation thereto, the Borrower Recipient shall: (a) prepare, on the basis of guidelines acceptable to the BankAssociation, and furnish to the Bank Association not later than six (6) months before after the Closing Date or such later date as may be agreed for this purpose between the Borrower, acting through MOH, Recipient and the BankAssociation, a plan for the future operation continued achievement of the Project’s objectives; and (b) afford the Bank Association a reasonable opportunity to exchange views with the Borrower Recipient on said plan.

Execution of the Project. (a) The Borrower declares its commitment to the objectives of the ProjectProject as set forth in Schedule 2 to this Agreement, and, to this end, shall carry out the Project through MOH CBR with due diligence and efficiency and in conformity with appropriate administrative, financial, technical, environmental taxation and health care engineering practices, and shall provide, promptly as needed, the funds, facilities, services and other resources required for the Project. (b) Without limitation upon the provisions of paragraph (a) of this Section and except as the Borrower and the Bank Association shall otherwise agree, the Borrower, acting through MOH, Borrower shall carry out the Project in accordance with the Implementation Program set forth in Schedule 5 4 to this Agreement. (a) Except as the Bank Association shall otherwise agree, procurement of the goods, works and consultants’ services required for the Project and to be financed out of the proceeds of the Loan Credit and the DFID Grant shall be governed by the provisions of Schedule 4 3 to this Agreement, as said provisions may be further elaborated in the Procurement Plan. (b) The Borrower shall update the Procurement Plan in accordance with terms of reference guidelines acceptable to the BankAssociation, and furnish such update to the Bank Association not later than twelve (12) 8 months after the date of the preceding Procurement Plan, for the BankAssociation’s approval. Section 3.03. For the purposes of Section 9.07 9.06 of the General Conditions and without limitation thereto, the Borrower shall: (a) prepare, on the basis of guidelines acceptable to the BankAssociation, and furnish to the Bank Association not later than six (6) months before after the Closing Date or such later date as may be agreed for this purpose between the Borrower, acting through MOH, Borrower and the BankAssociation, a plan for the future operation of the Project; and (b) afford the Bank Association a reasonable opportunity to exchange views with the Borrower on said plan.

Execution of the Project. (a) The Borrower declares its commitment to the objectives of the Project, and, to this end, the Borrower shall carry out Part A of the Project through MOH ANSVSA and MAFRD, and Parts B, C and D of the Project through MAFRD, with due diligence and efficiency and in conformity with appropriate administrative, financial, technical, environmental technical and health care administrative practices, and shall provide, promptly as needed, the funds, facilities, services and other resources required for the Project. (b) Without limitation upon the provisions of paragraph (a) of this Section Section, and except as the Borrower and the Bank shall otherwise agree, the Borrower, acting through MOHMAFRD and ANSVSA, shall carry out the Project in accordance with the Implementation Program set forth in Schedule 5 to this Agreement. (a) Except as the Bank shall otherwise agree, procurement of the goods, works and consultants’ services required for the Project and to be financed out of the proceeds of the Loan shall be governed by the provisions of Schedule 4 to this Agreement, as said provisions may be further elaborated in the Procurement Plan. (b) The Borrower shall shall, through MAFRD and ANSVSA, update the Procurement Plan in accordance with terms of reference guidelines acceptable to the Bank, and furnish such update to the Bank not later than twelve (12) months after the date of the preceding Procurement Plan, for the Bank’s approval. Section 3.03. For the purposes of Section 9.07 of the General Conditions and without limitation thereto, the Borrower shall: (a) prepare, on the basis of guidelines acceptable to the Bank, and furnish to the Bank not later than six (6) months before after the Closing Date or such later date as may be agreed for this purpose between the Borrower, acting through MOH, Borrower and the Bank, a plan for designed to ensure the future operation continued achievement of the objectives of the Project; and (b) afford the Bank a reasonable opportunity to exchange views with the Borrower on said plan.

Execution of the Project. (a) The Borrower declares its commitment to the objectives of the ProjectProject as set forth in Schedule 2 to this Agreement, and, to this end, shall carry out the Project through MOH with due diligence and efficiency and in conformity with appropriate administrative, financialengineering and financial practices, technical, and sound environmental and health care practicessocial standards, and shall provide, promptly as needed, the funds, facilities, services and other resources required for the Project. (b) Without limitation upon the provisions of paragraph (a) of this Section and except as the Borrower and the Bank Association shall otherwise agree, the Borrower, acting through MOH, Borrower shall carry out the Project in accordance with the Implementation Program set forth in Schedule 5 4 to this Agreement. (a) Except as the Bank Association shall otherwise agree, procurement of the goods, works and consultants’ services required for the Project and to be financed out of the proceeds of the Loan Credit shall be governed by the provisions of Schedule 4 3 to this Agreement, as said provisions may be further elaborated in the Procurement Plan. (b) The Borrower shall update the Procurement Plan in accordance with terms of reference acceptable to the BankAssociation, and furnish such update to the Bank Association not later than twelve (12) months after the date of the preceding Procurement Plan, for the BankAssociation’s approval. Section 3.03. For the purposes of Section 9.07 9.06 of the General Conditions and without limitation thereto, the Borrower shall: (a) prepare, on the basis of guidelines acceptable to the BankAssociation, and furnish to the Bank Association not later than six (6) months before after the Closing Date or such later date as may be agreed for this purpose between the Borrower, acting through MOH, Borrower and the BankAssociation, a plan for designed to ensure the future operation continued achievement of the Project’s objectives; and (b) afford the Bank Association a reasonable opportunity to exchange views with the Borrower on said plan.

Execution of the Project. (a) The Borrower declares its commitment to the objectives of the Project, and, to this end, shall carry out the Project through MOH the MSTTD with due diligence and efficiency and in conformity with appropriate administrative, financial, technical, financial and environmental and health care practices, and shall provide, promptly as needed, the funds, facilities, services and other resources required for the Project. (b) Without limitation upon the provisions of paragraph (a) of this Section and except as the Borrower and the Bank shall otherwise agree, the Borrower, acting through MOH, Borrower shall carry out the Project in accordance with the Implementation Program set forth in Schedule 5 to this Agreement. (a) Except as the Bank shall otherwise agree, procurement of the goods, works and consultants’ and technical services required for the Project and to be financed out of the proceeds of the Loan shall be governed by the provisions of Schedule 4 to this Agreement, as said provisions may be further elaborated in the Procurement Plan. (b) The Borrower shall update the Procurement Plan in accordance with terms of reference guidelines acceptable to the Bank, and furnish such update to the Bank not later than twelve (12) 12 months after the date of the preceding Procurement Plan, for the Bank’s approval. Section 3.03. For the purposes of Section 9.07 of the General Conditions and without limitation thereto, the Borrower shall: (a) prepare, on the basis of guidelines acceptable to the BankBank and the Borrower, and furnish to the Bank not later than six (6) months before after the Closing Date or such later date as may be agreed for this purpose between the Borrower, acting through MOH, Borrower and the Bank, a plan for information on the planned future operation development of the Project; and (b) afford the Bank a reasonable opportunity to exchange views with the Borrower on said plan.

Execution of the Project. (a) The Borrower declares its commitment to the objectives of the Project, and, to this end, shall carry out the Project through MOH Project, with due diligence and efficiency and in conformity with appropriate administrative, construction, ecological, engineering, environmental, financial, technicalhydraulic, environmental hydrologic and health care technical practices, and shall provide, promptly as needed, the funds, facilities, services and other resources required for the Project. (b) Without limitation upon the provisions of paragraph (a) of this Section and except as the Borrower and the Bank shall otherwise agree, the Borrower, acting through MOH, Borrower shall carry out the Project in accordance with the Implementation Program set forth in Schedule 5 to this Agreement. (a) Except as the Bank shall otherwise agree, procurement of the goods, works and consultants’ services required for the Project and to be financed out of the proceeds of the Loan shall be governed by the provisions of Schedule 4 to this Agreement, as said provisions may be further elaborated in the Procurement Plan. (b) The Borrower shall update the Procurement Plan in accordance with terms of reference guidelines acceptable to the Bank, and furnish such update to the Bank not later than twelve (12) months after the date of the preceding Procurement Plan, for the Bank’s approval. Section 3.03. Execution of the Project. (a) The Borrower declares its commitment to the objectives of the Project, and, to this end, shall carry out the Project Project, through MOH DepEd, with due diligence and efficiency and in conformity with appropriate educational, administrative, financialeconomic, technical, financial and managerial practices and sound social and environmental and health care practicesstandards acceptable to the Bank, and shall provide, promptly as needed, the funds, facilities, services and other resources required for the Project. (b) Without limitation upon the provisions of paragraph (a) of this Section and except as the Borrower and the Bank shall otherwise agree, the Borrower, acting through MOH, Borrower shall carry out the Project in accordance with the Implementation Program set forth in Schedule 5 4 to this Agreement. (a) Except as the Bank shall otherwise agree, procurement of the goods, works and consultants’ services required for the Project and to be financed out of the proceeds of the Loan shall be governed by the provisions of Schedule 4 5 to this Agreement, as said provisions may be further elaborated in the Procurement Plan. (b) The Borrower Borrower, through DepEd, shall update the Procurement Plan in accordance with terms of reference acceptable to the Bank, and furnish such update to the Bank not later than twelve (12) 12 months after the date of the preceding Procurement Plan, for the Bank’s approval. Section 3.03. For the purposes of Section 9.07 of the General Conditions and without limitation thereto, the Borrower shall: (a) prepare, on the basis of guidelines acceptable to the Bank, and furnish to the Bank not later than six (6) months before after the Closing Date or such later date as may be agreed for this purpose between the Borrower, acting through MOH, Borrower and the Bank, a plan for the future operation of the Project; and (b) afford the Bank a reasonable opportunity to exchange views with the Borrower on said plan.

Execution of the Project. (a) The Borrower declares its commitment to the objectives of the Project, and, to this end, shall carry out Part B of the Project through MOH with due diligence and efficiency and in conformity with appropriate administrative, financial, technicalaccounting, environmental engineering, environmental, and health care public utility practices, and shall provide, promptly as needed, the funds, facilities, services and other resources required for Part B of the Project. (b) Without limitation upon the provisions of paragraph (a) of this Section and except as the Borrower and the Bank shall otherwise agree, the Borrower, acting through MOH, Borrower shall carry out Part B of the Project in accordance with the Implementation Program set forth in Schedule 5 to this Agreement. (a) Section 3.02. Except as the Bank shall otherwise agree, procurement of the goods, works and consultants’ services goods required for Part B of the Project and to be financed out of the proceeds of the Loan shall be governed by the provisions of Schedule 4 to this Agreement, as said provisions may be further elaborated in the Procurement Plan. (b) The Section 3.03. Except as the Borrower and the Bank shall otherwise agree, the Borrower shall update the Procurement Plan in accordance with terms of reference acceptable provide evidence satisfactory to the Bank, and furnish such update to the Bank not by no later than twelve (12) months after the date October 30 of each year throughout implementation of Part B of the preceding Procurement PlanProject, that sufficient resources have been allocated in the Borrower’s annual budget to cover all the counterpart funding requirements under this Part B of the Project for the Bank’s approvalyear in question. Section 3.033.04. For the purposes of Section 9.07 of the General Conditions and without limitation thereto, the Borrower shall: (a) prepare, on the basis of guidelines acceptable to the Bank, and furnish to the Bank not later than six (6) months before after the Closing Date or such later date as may be agreed for this purpose between the Borrower, acting through MOH, Borrower and the Bank, a plan for designed to ensure the future operation sustainability of the Project; and (b) afford the Bank a reasonable opportunity to exchange views with the Borrower on said plan.

Execution of the Project. (a) The Borrower declares its commitment to the objectives of the Project, and, to this end, shall shall, through MHSW, carry out the Project through MOH with due diligence and efficiency and in conformity with appropriate administrative, financial, technical, environmental administrative and health care financial practices, and shall provide, promptly as needed, the funds, facilities, services and other resources required for the Project. (b) Without limitation upon the provisions of paragraph (a) of this Section and except as the Borrower and the Bank shall otherwise agree, the Borrower, acting through MOH, Borrower shall carry out the Project in accordance with the Implementation Program set forth in Schedule 5 to this Agreement. (a) Except as the Bank shall otherwise agree, procurement of the goodsworks, works goods and consultants’ services required for the Project and to be financed out of the proceeds of the Loan shall be governed by the provisions of Schedule 4 to this Agreement, as said provisions may be further elaborated in the Procurement Plan. (b) The Borrower shall update the Procurement Plan in accordance with terms of reference guidelines acceptable to the Bank, and furnish such update to the Bank not later than twelve (12) months after the date of the preceding Procurement Plan, for the Bank’s approval. Section 3.03. For the purposes of Section 9.07 of the General Conditions and without limitation thereto, the Borrower shall: (a) preparePrepare, on the basis of guidelines acceptable to the Bank, and furnish to the Bank not later than six (6) months before after the Closing Date or such later date as may be agreed for this purpose between the Borrower, acting through MOH, Borrower and the Bank, a plan for the future operation of the Project; and (b) afford Afford the Bank a reasonable opportunity to exchange views with the Borrower on said plan.

Execution of the Project. (a) The Borrower declares its commitment to the objectives of the Project, and, to this end, shall carry out the Project through MOH with due diligence and efficiency and in conformity with appropriate administrative, economic, engineering, financial, technicalpublic utility, water management and sanitation, and technical practices, and environmental and health care practicessocial standards, and shall provide, promptly as needed, the funds, facilities, services and other resources required for the Project. (b) Without limitation upon the provisions of paragraph (a) of this Section and except as the Borrower and the Bank shall otherwise agree, the Borrower, acting through MOH, Borrower shall carry out the Project in accordance with the Environmental Management Framework Plan, the Resettlement Policy Framework and the Implementation Program set forth in Schedule 5 to this Agreement. (a) Except as the Bank shall otherwise agree, procurement of the goods, works and consultants’ services required for the Project and to be financed out of the proceeds of the Loan shall be governed by the provisions of Schedule 4 to this Agreement, as said provisions may be further elaborated in the Procurement Plan. (b) The Borrower shall update the Procurement Plan in accordance with terms of reference guidelines acceptable to the Bank, and furnish such update to the Bank not later than twelve (12) months after the date of the preceding Procurement Plan, for the Bank’s approval. Section 3.03. For the purposes of Section 9.07 of the General Conditions and without limitation thereto, the Borrower shall: (a) prepare, on the basis of guidelines acceptable to the Bank, and furnish to the Bank not later than six (6) months before after the Closing Date or such later date as may be agreed for this purpose between the Borrower, acting through MOH, Borrower and the Bank, a plan for designed to ensure the future operation continued achievement of the ProjectProject objectives; and (b) afford the Bank a reasonable opportunity to exchange views with the Borrower on said plan.

Execution of the Project. (a) The Borrower declares its commitment to the objectives of the ProjectProject as set forth in Schedule 2 to this Agreement, and, to this end, shall carry out the Project through MOH the PMU with due diligence and efficiency and in conformity with appropriate administrative, financial, technical, engineering and environmental and health care practices, and shall provide, promptly as needed, the funds, facilities, services services, and other resources required for the Projectproject. (b) Without limitation upon the provisions of paragraph (a) of this Section and except as the Borrower and the Bank Association shall otherwise agree, the Borrower, acting through MOH, Borrower shall carry out the Project in accordance with the PIP and the Implementation Program set forth in Schedule 5 4 to this Agreement. (a) Except as the Bank Association shall otherwise agree, procurement of the goods, works and consultants’ services required for the Project and to be financed out of the proceeds of the Loan Credit shall be governed by the provisions of Schedule 4 3 to this Agreement, as said provisions may be further elaborated in the Procurement Plan. (b) The Borrower shall update the Procurement Plan in accordance with terms of reference guidelines acceptable to the BankAssociation, and furnish such update to the Bank Association not later than twelve (12) months after the date of the preceding Procurement Plan, for the BankAssociation’s approval. Section 3.03. (b) The Borrower shall update the Procurement Plan in accordance with terms of reference guidelines acceptable to the Bank, Association and furnish such update to the Bank Association not later than twelve (12) 12 months after the date of the preceding Procurement Plan, for the BankAssociation’s approval. Section 3.03. For the purposes of Section 9.07 9.06 of the General Conditions and without limitation thereto, the Borrower shall: (a) prepare, on the basis of guidelines acceptable to the BankAssociation, and furnish to the Bank Association not later than six (6) months before the Closing Date or such later date as may be agreed for this purpose between the Borrower, acting through MOH, Borrower and the BankAssociation, a plan for designed to ensure the future operation continued achievement of the Project’s objectives and the next phase of the Program; and (b) afford the Bank Association a reasonable opportunity to exchange views with the Borrower on said plan.

Execution of the Project. (a) The Borrower declares its commitment to the objectives of the Project, and, to this end, shall carry out the Project through MOH with due diligence and efficiency and in conformity with appropriate administrative, engineering, financial, technical, and road safety practices and sound environmental and health care practicessocial standards, and shall provide, promptly as needed, the funds, facilities, services and other resources required for the Project. (b) Without limitation upon the provisions of paragraph (a) of this Section and except as the Borrower and the Bank shall otherwise agree, the Borrower, acting through MOH, Borrower shall carry out the Project in accordance with the Implementation Program set forth in Schedule 5 to this Agreement. (a) Except as the Bank shall otherwise agree, procurement of the goods, works and consultants’ services required for the Project and to be financed out of the proceeds of the Loan shall be governed by the provisions of Schedule 4 to this Agreement, as said provisions may be further elaborated in the Procurement Plan. (b) The Borrower shall update the Procurement Plan in accordance with terms of reference acceptable to the Bank, and furnish such update to the Bank not later than twelve (12) 12 months after the date of the preceding Procurement Plan, for the Bank’s approval. (b) Without limitation upon the provisions of paragraph (a) of this Section and except as the Borrower Recipient and the Bank Association shall otherwise agree, the Borrower, acting through MOH, Recipient shall carry out the Project in accordance with the Implementation Program implementation program set forth in Schedule 5 4 to this Agreement. (a) Except as the Bank Association shall otherwise agree, procurement of the goods, works and consultants’ services required for the Project and to be financed out of the proceeds of the Loan Grant shall be governed by the provisions of Schedule 4 3 to this Agreement, as said provisions may be further elaborated in the Procurement Plan. (b) The Borrower Recipient shall update the Procurement Plan in accordance with terms of reference guidelines acceptable to the BankAssociation, and furnish such update to the Bank Association not later than twelve (12) months after the date of the preceding Procurement Plan, for the BankAssociation’s approval. Section 3.03. For the purposes of Section 9.07 9.06 of the General Conditions and without limitation thereto, the Borrower Recipient shall: (a) prepare, on the basis of guidelines acceptable to the BankAssociation, and furnish to the Bank Association not later than six (6) months before after the Closing Date or such later date as may be agreed for this purpose between the Borrower, acting through MOH, Recipient and the BankAssociation, a plan for the future operation of the Project; and (b) afford the Bank Association a reasonable opportunity to exchange views with the Borrower Recipient on said plan.

Execution of the Project. (a) The Borrower declares its commitment to the objectives of the Project, and, to this end, shall carry out the Project through MOH the Cadastre Agency with due diligence and efficiency and in conformity with appropriate administrative, financial, technical, environmental cadastral and health care real estate registration practices, and shall provide, promptly as needed, the funds, facilities, services and other resources required for the Project. (b) Without limitation upon the provisions of paragraph (a) of this Section and except as the Borrower and the Bank shall otherwise agree, the Borrower, acting through MOH, Borrower shall carry out the Project in accordance with the Implementation Program set forth in Schedule 5 to this Agreement. (a) Except as the Bank shall otherwise agree, procurement of the goods, works and consultants’ services required for the Project and to be financed out of the proceeds of the Loan shall be governed by the provisions of Schedule 4 to this Agreement, as said provisions may be further elaborated in the Procurement Plan. (b) The Borrower shall update the Procurement Plan in accordance with terms of reference guidelines acceptable to the Bank, and furnish such update to the Bank not later than twelve (12) 12 months after the date of the preceding Procurement Plan, for the Bank’s approval. Section 3.03. For the purposes of Section 9.07 of the General Conditions and without limitation thereto, the Borrower shall: (a) prepare, on the basis of guidelines acceptable to the Bank, and furnish to the Bank not later than six (6) months before after the Closing Date or such later date as may be agreed for this purpose between the Borrower, acting through MOH, Borrower and the Bank, a plan for designed to ensure the future operation continued achievement of the Project’s objectives; and (b) afford the Bank a reasonable opportunity to exchange views with the Borrower on said plan.

Execution of the Project. (a) The Borrower Recipient declares its commitment to the objectives of the ProjectProject as set forth in Schedule 2 to this Agreement, and, to this end, shall carry out the Project Project, through MOH MOE, with due diligence and efficiency and in conformity with appropriate education, administrative, financial, technical, environmental financial and health care technical practices, and shall provide, promptly as needed, the funds, facilities, services and other resources required for the Project. (b) Without limitation upon the provisions of paragraph (a) of this Section and except as the Borrower Recipient and the Bank Association shall otherwise agree, the Borrower, acting through MOH, Recipient shall carry out the Project in accordance with the Implementation Program set forth in Schedule 5 4 to this Agreement. (a) Except as the Bank Association shall otherwise agree, procurement of the goods, works works, and consultants’ services required for the Project and to be financed out of the proceeds of the Loan Grant shall be governed by the provisions of Schedule 4 3 to this Agreement, as said such provisions may be further elaborated in the Procurement Plan. (b) The Borrower Recipient shall update the Procurement Plan in accordance with terms of reference guidelines acceptable to the BankAssociation, and furnish such update to the Bank Association not later than twelve (12) months after the date of the preceding Procurement Plan, for the BankAssociation’s approval. Section 3.03. For the purposes of Section 9.07 9.06 of the General Conditions and without limitation thereto, the Borrower Recipient shall: (a) prepare, on the basis of guidelines acceptable to the BankAssociation, and furnish to the Bank Association not later than six (6) months before after the Closing Date or such later date as may be agreed for this purpose between the Borrower, acting through MOH, Recipient and the BankAssociation, a plan for the future operation continued achievement of the objectives of the Project; and (b) afford the Bank Association a reasonable opportunity to exchange views with the Borrower Recipient on said plan.

Execution of the Project. (a) The Borrower declares its commitment to the objectives of the ProjectProject as set forth in Schedule 2 to this Agreement, and, to this end, shall carry out the Project through MOH with due diligence and efficiency and in conformity with appropriate administrative, financial, technical, environmental and health care educational practices, and shall provide, promptly as needed, the funds, facilities, services and other resources required for the Project. (b) Without limitation upon the provisions of paragraph (a) of this Section and except as the Borrower and the Bank Association shall otherwise agree, the Borrower, acting through MOH, Borrower shall carry out the Project in accordance with the Implementation Program set forth in Schedule 5 4 to this Agreement. (a) Except as the Bank Association shall otherwise agree, procurement of the goods, works and consultants’ services required for the Project and to be financed out of the proceeds of the Loan Credit shall be governed by the provisions of Schedule 4 3 to this Agreement, as said provisions may be further elaborated in the Procurement Plan. (b) The Borrower shall update the Procurement Plan in accordance with terms of reference guidelines acceptable to the BankAssociation, and furnish such update to the Bank Association not later than twelve (12) 12 months after the date of the preceding Procurement Plan, for the BankAssociation’s approval. Section 3.03. For the purposes of Section 9.07 9.06 of the General Conditions and without limitation thereto, the Borrower shall: (a) prepare, on the basis of guidelines acceptable to the BankAssociation, and furnish to the Bank Association not later than six (6) months before after the Closing Date or such later date as may be agreed for this purpose between the Borrower, acting through MOH, Borrower and the BankAssociation, a plan for the future operation of the Project; and (b) afford the Bank Association a reasonable opportunity to exchange views with the Borrower on said plan.

Execution of the Project. (a) The Borrower declares its commitment to the objectives of the Project, and, to this end, shall carry out the Project Project, through MOH MAFWE, with due diligence and efficiency and in conformity with appropriate administrative, financial, technical, and environmental and health care practices, and shall provide, promptly as needed, the funds, facilities, services and other resources required for the Project. (b) Without limitation upon the provisions in paragraph (a) of this Section, the Borrower, through MAFWE, shall open a Project account under terms and conditions satisfactory to the Bank promptly after effectiveness of this Agreement and shall ensure that adequate budgetary allocations shall be made to the Project account each calendar quarter during Project implementation for financing Project expenditures; and (c) without limitation upon the provisions of paragraph (a) of this Section and except as the Borrower and the Bank shall otherwise agree, the Borrower, acting through MOHMAFWE, shall carry out the Project in accordance with the Implementation Program set forth in Schedule 5 to this Agreement. (a) Section 3.02. Except as the Bank shall otherwise agree, procurement of the goods, works and consultants’ services required for the Project and to be financed out of the proceeds of the Loan shall be governed by the provisions of Schedule 4 to this Agreement, as said provisions may be further elaborated in the Procurement Plan. (b) The Borrower shall update the Procurement Plan in accordance with terms of reference acceptable to the Bank, and furnish such update to the Bank not later than twelve (12) months after the date of the preceding Procurement Plan, for the Bank’s approval. Section 3.03. For the purposes of Section 9.07 of the General Conditions and without limitation thereto, the Borrower shall: (a) prepare, on the basis of guidelines acceptable to the Bank, and furnish to the Bank not later than six (6) months before after the Closing Date or such later date as may be agreed for this purpose between the Borrower, acting through MOH, Borrower and the Bank, a plan for the future operation of the Project; and (b) afford the Bank a reasonable opportunity to exchange views with the Borrower on said plan.

Execution of the Project. (a) The Borrower declares its commitment to the objectives of the Project, and, to this end, shall carry out the Project Project, through MOH MOJ, with due diligence and efficiency and in conformity with appropriate administrative, financial, technical, engineering, financial and environmental and health care practices, and shall provide, promptly as needed, the funds, facilities, services and other resources required for the Project. (b) Without limitation upon the provisions of paragraph (a) of this Section and except as the Borrower and the Bank shall otherwise agree, the Borrower, acting through MOHMOJ, shall carry out the Project in accordance with the Implementation Program set forth in Schedule 5 to this Agreement. (a) Except as the Bank shall otherwise agree, procurement of the goods, works and consultants’ services required for the Project and to be financed out of the proceeds of the Loan shall be governed by the provisions of Schedule 4 to this Agreement, as said provisions may be further elaborated in the Procurement Plan. (b) The Borrower Borrower, through MOJ, shall update the Procurement Plan in accordance with terms of reference guidelines acceptable to the Bank, and furnish such update to the Bank not later than twelve (12) months after the date of the preceding Procurement Plan, for the Bank’s approval. Section 3.03. For the purposes of Section 9.07 of the General Conditions and without limitation thereto, the Borrower Borrower, through MOJ, shall: (a) prepare, on the basis of guidelines acceptable to the Bank, and furnish to the Bank not later than six (6) months before after the Closing Date or such later date as may be agreed for this purpose between the Borrower, acting through MOH, Borrower and the Bank, a plan for the future operation of the Project; and (b) afford the Bank a reasonable opportunity to exchange views with the Borrower on said plan. Section 3.04. The Borrower shall ensure that its annual budget provides for sufficient funds for the operating and maintenance costs of: (i) the courts to be rehabilitated or constructed under Part A.1 of the Project; and (ii) the resource management system for the judicial sector to be developed under Part C.1 of the Project.

Execution of the Project. (a) The Borrower declares its commitment to the objectives of the Project, and, to this end, shall carry out Parts A and D of the Project through MOH with due diligence and efficiency and in conformity with appropriate administrative, financial, technicalengineering, public utility, and environmental and health care practices, and shall provide, promptly as needed, the funds, facilities, services and other resources required for Parts A and D of the Project. (b) Without limitation upon the provisions of paragraph (a) of this Section and except as the Borrower and the Bank shall otherwise agree, the Borrower, acting through MOH, Borrower shall carry out Parts A and D of the Project in accordance with the Implementation Program set forth in Schedule 5 to this Agreement. (a) Except as the Bank shall otherwise agree, procurement of the goods, works and consultants’ services required for Parts A and D of the Project and to be financed out of the proceeds of the Loan shall be governed by the provisions of Schedule 4 to this Agreement, as said provisions may be further elaborated in the Procurement Plan. (b) The Borrower shall update the Procurement Plan in accordance with terms of reference guidelines acceptable to the Bank, and furnish such update to the Bank not later than twelve (12) months after the date of the preceding Procurement Plan, for the Bank’s approval. Section 3.03. For the purposes of Section 9.07 of the General Conditions and without limitation thereto, the Borrower shall: (a) prepare, on the basis of guidelines acceptable to the Bank, and furnish to the Bank not later than six (6) months before after the Closing Date or such later date as may be agreed for this purpose between the Borrower, acting through MOH, Borrower and the Bank, a plan for designed to ensure the future operation continued achievement of Parts A and D of the ProjectProject objectives; and (b) afford the Bank a reasonable opportunity to exchange views with the Borrower on said plan.

Execution of the Project. (a) The Borrower Recipient declares its commitment to the objectives of the Project, Project as set forth in Schedule 2 to this Agreement and, to this end, shall carry out the Project through MOH with due diligence and efficiency and in conformity with appropriate educational, administrative, financial, technical, environmental financial and health care technical practices, and shall provide, promptly as needed, the funds, facilities, services and other resources required for the Project. (b) Without limitation upon the provisions of paragraph (a) of this Section and except as the Borrower Recipient and the Bank Association shall otherwise agree, the Borrower, acting through MOH, Recipient shall carry out the Project in accordance with the Implementation Program implementation program set forth in Schedule 5 4 to this Agreement, the Project Implementation Manual and the Environmental and Social Safeguards Framework. (a) Except as the Bank Association shall otherwise agree, procurement of the goods, works goods and consultants’ services required for the Project and to be financed out of the proceeds of the Loan Grant shall be governed by the provisions of Schedule 4 3 to this Agreement, as said provisions may be further elaborated in the Procurement Plan. (b) The Borrower Recipient shall update the Procurement Plan in accordance with terms of reference guidelines acceptable to the BankAssociation, and furnish such update to the Bank Association not later than twelve (12) months after the date of the preceding Procurement Plan, for the BankAssociation’s approval. Section 3.03. For the purposes of Section 9.07 9.06 of the General Conditions and without limitation thereto, the Borrower Recipient shall: (a) prepare, on the basis of guidelines acceptable to the BankAssociation, and furnish to the Bank Association not later than six (6) months before after the Closing Date or such later date as may be agreed for this purpose between the Borrower, acting through MOH, Recipient and the BankAssociation, a plan for to ensure the future operation continued achievement of the Project’s objectives; and (b) afford the Bank Association a reasonable opportunity to exchange views with the Borrower Recipient on said plan.

Execution of the Project. (a) The Borrower declares its commitment to the objectives of the Project, and, to this end, shall carry out the Project through MOH MOE with due diligence and efficiency and in conformity with appropriate administrative, economic, engineering, environmental, financial, technical, environmental management and health care technical practices, and shall provide, promptly as needed, the funds, facilities, services and other resources required for the Project. (b) Without limitation upon the provisions of paragraph (a) of this Section and except as the Borrower and the Bank shall otherwise agree, the BorrowerBorrower shall, acting through MOH, shall MOE carry out the Project in accordance with the Implementation Program set forth in Schedule 5 to this Agreement, the PIP and the Program. (a) Except as the Bank shall otherwise agree, procurement of the goods, goods and works and consultants’ services required for the Project and to be financed out of the proceeds of the Loan shall be governed by the provisions of Schedule 4 to this Agreement, as said provisions may be further elaborated in the Procurement Plan. (b) The Borrower shall shall, through MOE, update the Procurement Plan in accordance with terms of reference guidelines acceptable to the Bank, and furnish such update to the Bank not later than twelve (12) months after the date of the preceding Procurement Plan, for the Bank’s approval. Section 3.03. For the purposes of Section 9.07 of the General Conditions and without limitation thereto, the Borrower shall, through MOE: (a) prepare, on the basis of guidelines acceptable to the Bank, and furnish to the Bank not later than six (6) months before after the Closing Date or such later date as may be agreed for this purpose between the Borrower, acting through MOH, Borrower and the Bank, a plan for the future operation continued achievement of the objectives of the Project; and (b) afford the Bank a reasonable opportunity to exchange views with the Borrower on said plan.

Execution of the Project. (a) Section 3.01. The Borrower declares its commitment to the objectives of the ProjectProject as set forth in Schedule 2 to this Agreement, and, to this end, shall carry out the Project through MOH its MEN and OFPE with due diligence and efficiency and in conformity with appropriate administrative, financial, technicalengineer- ing, environmental training and health care education practices, and shall provide, promptly as needed, the funds, facilities, services and other resources required for the Project. (b) Without limitation upon the provisions of paragraph (a) of this Section and except as the Borrower and the Bank shall otherwise agree, the Borrower, acting through MOH, shall carry out the Project in accordance with the Implementation Program set forth in Schedule 5 to this Agreement. (a) 3.02. Except as the Bank shall otherwise agree, procurement pro- curement of the goods, works and consultants’ services required for the Project and to be financed out of the proceeds of the Loan shall be governed by the provisions of Schedule 4 to this Agreement, as said provisions may be further elaborated in the Procurement Plan. (b) The Borrower shall update the Procurement Plan in accordance with terms of reference acceptable to the Bank, and furnish such update to the Bank not later than twelve (12) months after the date of the preceding Procurement Plan, for the Bank’s approvalAgree- ment. Section 3.03. For the purposes of Section 9.07 overall coordination in the carrying out of the General Conditions Project and without limitation theretomonitoring its progress, the Borrower shall maintain a Project Coordinator in each of MEN and OFPE. Section 3.04. The Borrower shall: (a) not later than Octo- ber 31, each year review with the Bank: (i) the progress achieved in carrying out its reform program set forth in its Education and Training Sector Action Plan; (ii) the progress achieved in carrying out its school construction program referred to under Part A.1 of the Project; and (iii) the proposed investment and recurrent expenditures budgets of MEN for the following year, including the level of non-salary expenditures; and (b) based on such review, take all necessary measures to adjust such reform program, construction program and proposed investment and recurrent expenditures budgets. Section 3.05. For purposes of carrying out Part A.4 of the Project, the Borrower shall: : (a) prepare, on cause the basis schools to prepare and submit to its MEN for its approval pedagogical improvement plans comprising the elements set forth in Paragraph I of guidelines acceptable Schedule 6 to this Agreement which to be carried out require the Bank, acquisition of books and furnish educational materials to be financed under the Bank not later than six (6) months before the Closing Date or such later date as may be agreed for this purpose between the Borrower, acting through MOH, and the Bank, a plan for the future operation of the ProjectLoan; and (b) afford the Bank a reasonable opportunity to exchange views with the Borrower on said plan.

Execution of the Project. (a) The Borrower declares its commitment to the objectives of the Project, Project and, to this end, shall carry out the Project through MOH the MOLSP with due diligence and efficiency and in conformity with appropriate administrative, financialengineering, technical, environmental social assistance and health care technical practices, and shall provide, promptly as needed, the funds, facilities, services and other resources required for the Project. (b) Without limitation upon the provisions of paragraph (a) of this Section and except as the Borrower and the Bank shall otherwise agree, the Borrower, acting through MOH, Borrower shall carry out the Project in accordance with the Implementation Program set forth in Schedule 5 to this Agreement. (a) Except as the Bank shall otherwise agree, procurement of the goods, works works, services (other than consultants’ services) and consultants’ services required for the Project and to be financed out of the proceeds of the Loan shall be governed by the provisions of Schedule 4 to this Agreement, as said provisions may be further elaborated in the Procurement Plan. (b) The Borrower shall through the MOLSP update the Procurement Plan in accordance with terms of reference acceptable to the Bank, and furnish such update to the Bank not later than twelve (12) months after the date of the preceding Procurement Plan, for the Bank’s approval. Section 3.03. For the purposes of Section 9.07 of the General Conditions and without limitation thereto, the Borrower through the MOLSP shall: (a) prepare, on the basis of guidelines acceptable to the Bank, and furnish to the Bank not later than six (6) months before after the Closing Date or such later date as may be agreed for this purpose between the Borrower, acting through MOH, Borrower and the Bank, a plan for the future operation of the Project; and (b) afford the Bank a reasonable opportunity to exchange views with the Borrower on said plan.

Execution of the Project. (a) The Borrower declares its commitment to the objectives of the ProjectProject as set forth in Schedule 2 to this Agreement, and, to this end, shall carry out the Project through MOH with due diligence and efficiency and in conformity with appropriate administrative, financial, technical, environmental engineering and health care public utility practices, and shall provide, promptly as needed, the funds, facilities, services and other resources required for the Project. (b) Without limitation upon the provisions of paragraph (a) of this Section and except as the Borrower Bank and the Bank Borrower shall otherwise agree, the Borrower, acting through MOH, Borrower shall carry out the Project in accordance with the Implementation Program set forth in Schedule 5 to this Agreement. (a) Except as the Bank shall otherwise agree, procurement of the goods, works and consultants’ services required for the Project and to be financed out of the proceeds of the Loan shall be governed by the provisions of Schedule 4 to this Agreement, as said provisions may be further elaborated in the Procurement Plan. (b) Section 3.02. The Borrower shall update the Procurement Plan in accordance with terms of reference acceptable to the Bank, and furnish such update to the Bank not later than twelve (12) months after the date of the preceding Procurement Plan, for the Bank’s approval. Section 3.03. For the purposes of Section 9.07 of the General Conditions and without limitation thereto, the Borrower shall: : (a) prepare, on the basis following an exchange of guidelines acceptable to views with the Bank, and furnish to the Bank not later than six Bank, by October 31 in each year, a Corporate Performance Plan (6CPP) months before for the Closing Date or such later date as may be agreed for this purpose between following fiscal year of the Borrower, acting through MOHwhich shall set forth, in a manner consistent with the Borrower’s obligations under the Loan Agreement: (i) the physical targets for the Borrower, including the components of the Program to be carried out during the concerned fiscal year and the investments under such components to be financed from the proceeds of the Loan; (ii) the financial targets for the Borrower, including a financial projection showing whether the Borrower would comply with its obligations under Section 5.02 (a) of this Agreement, the measures for financial restructuring and the actions to be taken towards implementation of the FMIP, (iii) the operational and commercialization targets for the Borrower, including actions to be taken towards implementation of the OMIP, and (iv) the BankBorrower’s levels of services, a borrowing needs, financing plan for the future operation of the Project; and (b) afford the Bank a reasonable opportunity to exchange views with the Borrower on said plan.and tariff levels and structures;

Execution of the Project. (a) The Borrower declares its commitment to the objectives of the ProjectProject as set forth in Schedule 2 to this Agreement, and, to this end, shall carry out the Project through MOH with due diligence and efficiency and in conformity with appropriate administrative, financialengineering, technicalenvironmental, environmental financial and health care practicessocialpractices, and shall provide, promptly as needed, the funds, facilities, services and other resources required for the Project. (b) Without limitation on the provisions of paragraph (a) of this Section, the Borrower shall take all necessary measures to: (i) ensure that the financing of the Project from its own resources is maintained during the implementation of the Project at such levels as agreed between the Borrower and the Bank, such level to be at least equal to twenty million Rupiah (Rp. 20,000,000) per Project Village to be made available to each Project Village as an initial advance not later than April 30, 1997 and April 30, 1998; and (ii) make available an amount up to one hundred and twenty million Rupiah (Rp. 120,000,000) to each Project Village on a grant basis for the financing of Sub-projects. (c) Without limitation upon the provisions of paragraph (a) of this Section and except as the Borrower and the Bank shall otherwise agree, the Borrower, acting through MOH, Borrower shall carry out the Project in accordance with the Implementation Program set forth in Schedule 5 to this Agreement. (a) Section 3.02. Except as the Bank shall otherwise agree, procurement of the goods, works and consultants’ services required for the Project and to be financed out of the proceeds of the Loan shall be governed by the provisions of Schedule 4 to this Agreement, as said provisions may be further elaborated in the Procurement Plan. (b) The Borrower shall update the Procurement Plan in accordance with terms of reference acceptable to the Bank, and furnish such update to the Bank not later than twelve (12) months after the date of the preceding Procurement Plan, for the Bank’s approval. Section 3.03. For the purposes of Section 9.07 9.08 of the General Conditions and without limitation thereto, the Borrower shall: (a) prepare, on the basis of guidelines acceptable to the Bank, and furnish to the Bank not later than six (6) months before after the Closing Date or such later date as may be agreed for this purpose between the Borrower, acting through MOH, Borrower and the Bank, a plan for designed to ensure the future operation continued achievement of the objectives of the Project; and (b) afford the Bank a reasonable opportunity to exchange views with the Borrower on said plan.

Execution of the Project. (a) The Borrower Recipient declares its commitment to the objectives of the Project, Project as set forth in Schedule 2 to this Agreement and, to this end, shall carry out the Project through MOH with due diligence and efficiency and in conformity with appropriate administrative, financial, technical, technical and environmental practices and health care practiceswith due regard to ecological and environmental factors, and shall provide, promptly as needed, the funds, facilities, services and other resources required for the Project. (b) Without limitation upon the provisions of paragraph (a) of this Section and except as the Borrower Recipient and the Bank shall otherwise agree, the Borrower, acting through MOH, Recipient shall carry out the Project in accordance with the Implementation Program set forth in Schedule 5 4 to this Agreement. (a) Except as the Bank shall otherwise agree, procurement of the goods, works goods and consultants’ services required for the Project and to be financed out of the proceeds of the Loan NBTF Grant shall be governed by the provisions of Schedule 4 3 to this Agreement, as said provisions may be further elaborated in the Procurement Plan. (b) The Borrower Recipient shall update the Procurement Plan in accordance with terms of reference guidelines acceptable to the Bank, and furnish such update to the Bank not later than twelve (12) 12 months after the date of the preceding Procurement Plan, for the Bank’s approval. Section 3.03. For the purposes of Section 9.07 of the General Conditions and without limitation thereto, the Borrower Recipient shall: (a) prepare, on the basis of guidelines acceptable to the Bank, and furnish to the Bank not later than six (6) months before after the Closing Date or such later date as may be agreed for this purpose between the Borrower, acting through MOH, Recipient and the Bank, a plan for the future operation and sustainability of the Project; and (b) afford the Bank a reasonable opportunity to exchange views with the Borrower Recipient on said plan.

Execution of the Project. (a) The Borrower declares its commitment to the objectives of the ProjectProject as set forth in Schedule 2 to this Agreement, and, to this end, shall carry out the Project through MOH with due diligence and efficiency and in conformity with appropriate administrative, financial, technical, and environmental and health care practices, and shall provide, promptly as needed, the funds, facilities, services and other resources required for the Project. (b) Without limitation upon the provisions of paragraph (a) of this Section and except as the Borrower and the Bank Association shall otherwise agree, the Borrower, acting through MOH, Borrower shall carry out the Project in accordance with the Implementation Program set forth in Schedule 5 4 to this Agreement, the Environmental Management Plan, the Operations Manual and the provisions of the Cooperation Agreement for Project Assistance. (a) Section 3.02. Except as the Bank Association shall otherwise agree, procurement of the goods, works works, and consultants’ services required for Parts ▇, ▇.▇, ▇, ▇, ▇.▇, ▇.▇, ▇.▇, ▇.▇, ▇.▇, J and K.1 of the Project and to be financed out of the proceeds of the Loan Credit shall be governed by the provisions of Schedule 4 3 to this Agreement, as said provisions may be further elaborated in the Procurement Plan. (b) The Borrower shall update the Procurement Plan in accordance with terms of reference acceptable to the Bank, and furnish such update to the Bank not later than twelve (12) months after the date of the preceding Procurement Plan, for the Bank’s approval. Section 3.03. For the purposes of Section 9.07 of the General Conditions and without limitation thereto, the Borrower shall: : (a) prepare, on the basis of guidelines acceptable to the BankAssociation, and furnish to the Bank Association not later than six (6) months before after the Closing Date or such later date as may be agreed for this purpose between the Borrower, acting through MOH, Borrower and the BankAssociation, a plan for the future operation continued achievement of the Project’s objectives; and and (b) afford the Bank Association a reasonable opportunity to exchange views with the Borrower on said plan. Section 3.04. The Borrower shall, until completion of the Project: (a) retain UNICEF under the Cooperation Agreement for Project Assistance; and (b) promptly inform the Association of any condition, act, omission or potential dispute which shall interfere, or threaten to interfere, with the performance of either party of its obligations under the Cooperation Agreement for Project Assistance.

Execution of the Project. (a) The Borrower declares its commitment to the objectives of the ProjectProject as set forth in Schedule 2 to this Agreement, and, to this end, shall carry out the Project through MOH with due diligence and efficiency and in conformity with appropriate administrative, financial, technical, environmental engineering and health care accounting and auditing practices, and shall provide, promptly as needed, the funds, facilities, services and other resources required for the Project. (b) Without limitation upon the provisions of paragraph (a) of this Section and except as the Borrower and the Bank Association shall otherwise agree, the Borrower, acting through MOH, Borrower shall carry out the Project in accordance with the Implementation Program set forth in Schedule 5 4 to this Agreement. (a) Except as the Bank Association shall otherwise agree, procurement of the goods, works and consultants’ services required for the Project and to be financed out of the proceeds of the Loan Credit shall be governed by the provisions of Schedule 4 3 to this Agreement, as said provisions may be further elaborated in the Procurement Plan. (b) The Borrower shall update the Procurement Plan in accordance with terms of reference guidelines acceptable to the BankAssociation, and furnish such update to the Bank Association not later than twelve (12) months after the date of the preceding Procurement Plan, for the BankAssociation’s approval. Section 3.03. For the purposes of Section 9.07 9.06 of the General Conditions and without limitation thereto, the Borrower shall: (a) prepare, on the basis of guidelines acceptable to the BankAssociation, and furnish to the Bank Association not later than six (6) months before after the Closing Date or such later date as may be agreed for this purpose between the Borrower, acting through MOH, Borrower and the BankAssociation, a plan for designed to ensure the future operation continued achievement of the Project’s objectives; and (b) afford the Bank Association a reasonable opportunity to exchange views with the Borrower on said plan.

Execution of the Project. (a) The Borrower declares its commitment to the objectives of the Project, Project as set forth in Schedule 2 to this Agreement and, to this end, shall carry out the Project through MOH with due diligence and efficiency and in conformity with appropriate administrative, financial, technical, health and environmental and health care practices, and shall provide, promptly as needed, the funds, facilities, services and other resources required for the Project.Project and the Program; and (b) Without limitation upon the provisions of paragraph (a) of this Section and and, except as the Borrower and the Bank Association shall otherwise agree, the Borrower, acting through MOH, Borrower shall carry out the Project in accordance with the Implementation Program set forth in Schedule 5 4 to this Agreement. (a) Section 3.02. Except as the Bank Association shall otherwise agree, procurement of the goods, works and consultants’ services required for the Project and to be financed out of the proceeds of the Loan Credit shall be governed by the provisions of Schedule 4 3 to this Agreement, as said provisions may be further elaborated in the Procurement Plan. (b) The Borrower shall update the Procurement Plan in accordance with terms of reference acceptable to the Bank, and furnish such update to the Bank not later than twelve (12) months after the date of the preceding Procurement Plan, for the Bank’s approval. Section 3.03. For the purposes of Section 9.07 of the General Conditions and without limitation thereto, the Borrower shall: (a) prepare, on the basis of guidelines acceptable to the BankAssociation, and furnish to the Bank Association not later than six (6) months before after the Closing Date or such later date as may be agreed for this purpose between the Borrower, acting through MOH, Borrower and the BankAssociation, a plan for designed to ensure the future operation continued achievement of the objectives of the Project; and (b) afford the Bank Association a reasonable opportunity to exchange views with the Borrower on said plan. Section 3.04. Without limitation upon the provisions of Section 3.01 of this Agreement, the Borrower shall: (a) open and maintain a Project Account in a commercial bank on terms and conditions satisfactory to the Association; (b) deposit into the Project Account an initial amount equivalent to $200,000; (c) thereafter, replenish the Project Account through quarterly deposits, March 15, June 15, September 15 and December 15 of each year until the Closing Date, its counterpart funds required pursuant to the annual work program for the respective year, established in accordance with the procedures set fort in paragraph 5 of Schedule 4 to this Agreement; and (d) ensure that funds deposited into the Project Account shall be used only for the purposes of defraying the cost of expenditures incurred in the execution of the Project which are not financed out of the proceeds of the Credit. Section 3.05. The Borrower shall: (a) by May 30, 2000, carry out the Beneficiaries Assessment referred to under Part E (2) of the Project in accordance with terms of reference satisfactory to the Association; (b) promptly thereafter, submit to the Association the results of the said Beneficiaries’ Assessment for its review and comments; (c) finalize the Beneficiaries Assessment by taking duly into account the comments made by the Association; and promptly implement the recommendations of the Beneficiaries Assessment.

Execution of the Project. (a) The Borrower Recipient declares its commitment to the objectives of the Project, Project as set forth in Schedule 2 to this Agreement and, to this end, shall carry out the Project through MOH with due diligence and efficiency and in conformity with appropriate administrativetechnical, financial, technicaladministrative and financial practices and with due regard to ecological, environmental and health care practicessocial factors, and shall provide, promptly as needed, the funds, facilities, services and other resources required for the Project. (b) Without limitation upon the provisions of paragraph (a) of this Section and except as the Borrower Recipient and the Bank shall otherwise agree, the Borrower, acting through MOH, Recipient shall carry out the Project in accordance with the Implementation Program set forth in Schedule 5 4 to this Agreement. (a) Except as the Bank shall otherwise agree, procurement of the goods, works and consultants’ services required for the Project and to be financed out of the proceeds of the Loan GEF Trust Fund Grant shall be governed by the provisions of Schedule 4 3 to this Agreement, as said provisions may be further elaborated in the Procurement Plan. (b) The Borrower Recipient shall update the Procurement Plan in accordance with terms of reference guidelines acceptable to the Bank, and furnish such update to the Bank not later than twelve (12) 12 months after the date of the preceding Procurement Plan, for the Bank’s approval. Section 3.03. For the purposes of Section 9.07 9.08 of the General Conditions and without limitation thereto, the Borrower Recipient shall: (a) prepare, on the basis of guidelines acceptable to the Bank, and furnish to the Bank not later than six (6) months before after the Closing Date or such later date as may be agreed for this purpose between the Borrower, acting through MOH, Recipient and the Bank, a plan for designed to ensure the future operation continued achievement of the objectives of the Project; and (b) afford the Bank a reasonable opportunity to exchange views with the Borrower Recipient on said plan.

Execution of the Project. (a) The Borrower Recipient declares its commitment to the objectives of the Project, Project as set forth in Schedule 2 to this Agreement and, to this end, shall carry out the Project Project, through MOH DWR, with due diligence and efficiency and in conformity with appropriate administrative, environmental, financial, technical, environmental economic and health care practices, engineering practices and shall provide, promptly as needed, the funds, facilities, services and other resources required for the Project. (b) Without limitation upon the provisions of paragraph (a) of this Section and except as the Borrower Recipient and the Bank Association shall otherwise agree, the BorrowerRecipient, acting through MOHDWR, shall carry out the Project in accordance with the Implementation Program set forth in Schedule 5 4 to this Agreement. (a) Except as the Bank Association shall otherwise agree, procurement of the goods, works and consultants’ services required for the Project and to be financed out of the proceeds of the Loan Grant shall be governed by the provisions of Schedule 4 3 to this Agreement, as said provisions may be further elaborated in the Procurement Plan. (b) The Borrower Recipient shall update the Procurement Plan in accordance with terms of reference guidelines acceptable to the BankAssociation, and furnish such update to the Bank Association not later than twelve (12) months after the date of the preceding Procurement Plan, for the BankAssociation’s approval. Section 3.03. For the purposes of Section 9.07 9.06 of the General Conditions and without limitation thereto, the Borrower Recipient shall: (a) prepare, on the basis of guidelines acceptable to the BankAssociation, and furnish to the Bank Association not later than six (6) months before after the Closing Date or such later date as may be agreed for this purpose between the Borrower, acting through MOH, Recipient and the BankAssociation, a plan for designated to ensure the future operation sustainability of the Project; and (b) afford the Bank Association a reasonable opportunity to exchange views with the Borrower Recipient on said plan.

Execution of the Project. (a) The Borrower declares its commitment to the objectives of the Project, and, to this end, shall carry out the Project through MOH MoSES with due diligence and efficiency and in conformity with appropriate administrative, financial, technical, educational and environmental and health care practices, and shall provide, promptly as needed, the funds, facilities, services and other resources required for the Project. (b) Without limitation upon the provisions of paragraph (a) of this Section and except as the Borrower and the Bank shall otherwise agree, the BorrowerBorrower shall, acting through MOHMoSES, shall carry out the Project in accordance with the Implementation Program set forth in Schedule 5 to this AgreementAgreement and with the Operational Manual. (a) Except as the Bank shall otherwise agree, procurement of the goods, works and consultants’ services required for the Project and to be financed out of the proceeds of the Loan shall be governed by the provisions of Schedule 4 to this Agreement, as said provisions may be further elaborated in the Procurement Plan. (b) . The Borrower Borrower, through MoSES, shall update the Procurement Plan in accordance with terms of reference acceptable to guidelines agreed upon between MoSES and the Bank, and furnish such update updates to the Bank not later than twelve (12) months after at the date of the preceding Procurement Plan, same time when a respective ADP shall be submitted for the Bank’s approvalapproval pursuant to the provisions of paragraph 3 of Schedule 5 to this Agreement. Section 3.03. For the purposes of Section 9.07 of the General Conditions and without limitation thereto, the Borrower Borrower, through MoSES, shall: (a) prepare, on the basis of guidelines acceptable to the Bank, and furnish to the Bank not later than six two (62) months before after the Closing Date or such later date as may be agreed for this purpose between the Borrower, acting through MOH, Borrower and the Bank, a plan for designed to ensure the future operation continued achievement of the Project’s objectives; and (b) afford the Bank a reasonable opportunity to exchange views with the Borrower on said plan.

Execution of the Project. (a) The Borrower declares its commitment to the objectives of the Project, and, to this end, shall carry out the Project through MOH the Project Implementing Agencies with due diligence and efficiency and in conformity with appropriate administrativeengineering, financialenvironmental, technical, environmental administrative and health care financial practices, and shall provide, promptly as needed, the funds, facilities, services and other resources required for the Project. (b) Without limitation upon the provisions of paragraph (a) of this Section and except as the Borrower and the Bank shall otherwise agree, the Borrower, acting through MOH, Borrower shall carry out the Project in accordance with the Implementation Program set forth in Schedule 5 to this Agreement. (a) Except as the Bank shall otherwise agree, procurement of the goods, works and consultants’ services required for the Project and to be financed out of the proceeds of the Loan shall be governed by the provisions of Schedule 4 to this Agreement, as said provisions may be further elaborated in the Procurement Plan. (b) The Borrower shall update the Procurement Plan in accordance with terms of reference guidelines acceptable to the Bank, and furnish such update to the Bank not later than twelve (12) months after the date of the preceding Procurement Plan, for the Bank’s approval. Section 3.03. For the purposes of Section 9.07 of the General Conditions and without limitation thereto, the Borrower shall: (a) prepare, on the basis of guidelines acceptable to the Bank, and furnish to the Bank not later than six (6) months before after the Closing Date or such later date as may be agreed for this purpose between the Borrower, acting through MOH, Borrower and the Bank, a plan for the future operation continued achievement of the objectives of the Project; and (b) afford the Bank a reasonable opportunity to exchange views with the Borrower on said plan.

Execution of the Project. (a) The Borrower Recipient declares its commitment to the objectives of the Project, Project as set forth in Schedule 2 to this Agreement and, to this end, shall carry out the Project through MOH with due diligence and efficiency and in conformity with appropriate environmental, administrative, financial, technical, financial and technical practices and with due regard to ecological and environmental and health care practicesfactors, and shall provide, promptly as needed, the funds, facilities, services and other resources required for the Project. (b) Without limitation upon the provisions of paragraph (a) of this Section and except as the Borrower Recipient and the Bank shall otherwise agree, the Borrower, acting through MOH, Recipient shall carry out the Project in accordance with the Implementation Program set forth in Schedule 5 4 to this Agreement. (a) Except as the Bank shall otherwise agree, procurement of the goods, works and consultants’ services required for the Project and to be financed out of the proceeds of the Loan GEF Trust Fund Grant shall be governed by the provisions of Schedule 4 3 to this Agreement, as said provisions may be further elaborated in the Procurement Plan. (b) The Borrower Recipient shall update the Procurement Plan in accordance with terms of reference guidelines acceptable to the Bank, and furnish such update to the Bank not later than twelve (12) 12 months after the date of the preceding Procurement Plan, for the Bank’s approval. Section 3.03. For the purposes of Section 9.07 9.08 of the General Conditions and without limitation thereto, the Borrower Recipient shall: (a) prepare, on the basis of guidelines acceptable to the Bank, and furnish to the Bank not later than six (6) months before after the Closing Date or such later date as may be agreed for this purpose between the Borrower, acting through MOH, Recipient and the Bank, a plan for the future operation of the Project; and (b) afford the Bank a reasonable opportunity to exchange views with the Borrower Recipient on said plan.

Execution of the Project. (a) The Borrower Recipient declares its commitment to the objectives of the Project, Project as set forth in Schedule 2 to this Agreement and, to this end, shall carry out the Project through MOH the National Malaria Control Unit within the Ministry of Health with due diligence and efficiency and in conformity with appropriate administrative, financial, technicalmedical, environmental and health care financial practices, and shall provide, promptly as needed, the funds, facilities, services and other resources required for the Project. (b) Without limitation upon the provisions of paragraph (a) of this Section and except as the Borrower Recipient and the Bank Association shall otherwise agree, the Borrower, acting through MOH, Recipient shall carry out the Project in accordance with the Implementation Program implementation program set forth in Schedule 5 4 to this Agreement. (a) Except as the Bank Association shall otherwise agree, procurement of the goods, works and consultants’ services required for the Project and to be financed out of the proceeds of the Loan Grant shall be governed by the provisions of Schedule 4 3 to this Agreement, as said provisions may be further elaborated in the Procurement Plan. (b) The Borrower Recipient shall update the Procurement Plan in accordance with terms of reference guidelines acceptable to the BankAssociation, and furnish such update to the Bank Association not later than twelve (12) 12 months after the date of the preceding Procurement Plan, for the BankAssociation’s approval. Section 3.03. For the purposes of Section 9.07 9.06 of the General Conditions and without limitation thereto, the Borrower Recipient shall: (a) prepare, on the basis of guidelines acceptable to the BankAssociation, and furnish to the Bank Association not later than six (6) months before after the Closing Date or such later date as may be agreed for this purpose between the Borrower, acting through MOH, Recipient and the BankAssociation, a plan for the future operation of the Project; and (b) afford the Bank Association a reasonable opportunity to exchange views with the Borrower Recipient on said plan.

Execution of the Project. (a) The Borrower declares its commitment to the objectives of the ProjectProject as set forth in Schedule 2 to this Agreement, and, to this end, shall carry out the Project through MOH with due diligence and efficiency and in conformity with appropriate administrative, financial, technicalbanking, accounting and environmental and health care practices, and shall provide, promptly as needed, the funds, facilities, services and other resources required for the Project. (b) Without limitation upon the provisions of paragraph (a) of this Section and except as the Borrower and the Bank shall otherwise agree, the Borrower, acting through MOH, Borrower shall carry out the Project in accordance with the Implementation Program set forth in Schedule 5 to this Agreement. (a) Section 3.02. Except as the Bank shall otherwise agree, procurement of the goods, goods and works and consultants’ services required for the Project and to be financed out of the proceeds of the Loan shall be governed by the provisions of Schedule 4 to this Agreement, as said provisions may be further elaborated in the Procurement Plan. (b) The Borrower shall update the Procurement Plan in accordance with terms of reference acceptable to the Bank, and furnish such update to the Bank not later than twelve (12) months after the date of the preceding Procurement Plan, for the Bank’s approval. Section 3.03. For the purposes of Section 9.07 9.08 of the General Conditions and without limitation thereto, the Borrower shall: (a) prepare, on the basis of guidelines acceptable to the Bank, and furnish to the Bank not later than six (6) months before after the Closing Date or such later date as may be agreed for this purpose between the Borrower, acting through MOH, Borrower and the Bank, a plan for the future operation of the Project; and (b) afford the Bank a reasonable opportunity to exchange views with the Borrower on said plan. Section 3.04. The Borrower shall maintain the PMU in accordance with a staffing, plan and terms of reference satisfactory to the Bank. Section 3.05. The Borrower shall maintain the RBC as a separate legal entity with statutes, operational guidelines and staff acceptable to the Bank.

Execution of the Project. (a) The Borrower declares its commitment to the objectives of the ProjectProject as set forth in Schedule 2 to this Agreement, and, to this end, shall carry out the Project through MOH with due diligence and efficiency and in conformity with appropriate administrative, financial, technical, engineering and environmental and health care practices, and shall provide, promptly as needed, the funds, facilities, services and other resources required for the Project. (b) Without limitation upon the provisions of paragraph (a) of this Section and except as the Borrower and the Bank shall otherwise agree, the Borrower, acting through MOH, Borrower shall carry out the Project in accordance with the Implementation Program set forth in Schedule 5 to this Agreement. (a) Section 3.02. Except as the Bank shall otherwise agree, procurement of the goods, works and consultants’ services required for the Project and to be financed out of the proceeds of the Loan shall be governed by the provisions of Schedule 4 to this Agreement, as said provisions may be further elaborated in the Procurement Plan. (b) The Borrower shall update the Procurement Plan in accordance with terms of reference acceptable to the Bank, and furnish such update to the Bank not later than twelve (12) months after the date of the preceding Procurement Plan, for the Bank’s approval. Section 3.03. For the purposes of Section 9.07 9.08 of the General Conditions and without limitation thereto, the Borrower shall: (a) prepare, on the basis of guidelines acceptable to the Bank, and furnish to the Bank not later than six (6) months before after the Closing Date or such later date as may be agreed for this purpose between the Borrower, acting through MOH, Borrower and the Bank, a plan for designed to ensure the future operation continued achievement of the Project’s objectives; and and (b) afford the Bank a reasonable opportunity to exchange views with the Borrower on said plan. Section 3.04. The Borrower shall submit for review by the Bank, not later than September 30, 1997, a study establishing the level and structure of road user charges and the methodology establishing the same. Section 3.05. The Borrower shall: (a) conduct annual reviews of the RRP and develop work programs for the subsequent fiscal year, with the objective of establishing priorities for road rehabilitation and maintenance works on the basis of criteria acceptable to the Bank, including the requirement that such rehabilitation works have an internal rate of return of at least fifteen (15) percent; and

Execution of the Project. (a) The Borrower declares its commitment to the objectives of the ProjectProject as set forth in Schedule 2 to this Agreement, and, to this end, shall carry out the Project through MOH MOF and its General Department of Vietnam Customs with due diligence and efficiency and in conformity with appropriate administrative, financialmanagement, technical, environmental financial and health care customs practices, and shall provide, promptly as needed, the funds, facilities, services and other resources required for the Project. (b) Without limitation upon the provisions of paragraph (a) of this Section and except as the Borrower and the Bank Association shall otherwise agree, the Borrower, acting through MOH, Borrower shall carry out the Project in accordance with the Implementation Program set forth in Schedule 5 4 to this Agreement. (a) Except as the Bank Association shall otherwise agree, procurement of the goods, works and consultants’ services required for the Project and to be financed out of the proceeds of the Loan Credit shall be governed by the provisions of Schedule 4 3 to this Agreement, as said provisions may be further elaborated in the Procurement Plan. (b) The Borrower shall update the Procurement Plan in accordance with terms of reference guidelines acceptable to the BankAssociation, and furnish such update to the Bank Association not later than twelve (12) months after the date of the preceding Procurement Plan, for the BankAssociation’s approval. Section 3.03. For the purposes of Section 9.07 9.06 of the General Conditions and without limitation thereto, the Borrower shall: (a) prepare, on the basis of guidelines acceptable to the BankAssociation, and furnish to the Bank Association not later than six (6) months before after the Closing Date or such later date as may be agreed for this purpose between the Borrower, acting through MOH, Borrower and the BankAssociation, a plan for designed to ensure the future operation continued achievement of the objectives of the Project; and (b) afford the Bank Association a reasonable opportunity to exchange views with the Borrower on said plan.

Execution of the Project. (a) The Borrower Recipient declares its commitment to the objectives of the ProjectProject as set forth in Schedule 2 to this Agreement, and, to this end, shall carry out the Project through MOH with due diligence and efficiency and in conformity with appropriate administrative, financial, technical, environmental technical and health care educational practices, and shall provide, promptly as needed, the funds, facilities, services and other resources required for the Project. (b) Without limitation upon the provisions of paragraph (a) of this Section and except as the Borrower Recipient and the Bank Administrator shall otherwise agree, the Borrower, acting through MOH, Recipient shall carry out the Project in accordance with the Implementation Program set forth in Schedule 5 4 to this Agreement. (a) Except as the Bank Administrator shall otherwise agree, procurement of the goods, works and consultants’ services required for the Project and to be financed out of the proceeds of the Loan Grant shall be governed by the provisions of Schedule 4 3 to this Agreement, as said provisions may be further elaborated in the Procurement Plan. (b) The Borrower Recipient shall update the Procurement Plan in accordance with terms of reference acceptable to the Bank, Administrator and furnish such update to the Bank Administrator not later than twelve (12) 12 months after the date of the preceding Procurement Plan, for the BankAdministrator’s approval. Section 3.03. For the purposes of Section 9.07 9.06 (c) of the General Conditions and without limitation thereto, the Borrower Recipient shall: (a) prepare, on the basis of guidelines acceptable to the BankAdministrator, and furnish to the Bank Administrator not later than six (6) months before after the Closing Date or such later date as may be agreed for this purpose between the Borrower, acting through MOH, Recipient and the BankAdministrator, a plan for designed to ensure the future operation continued achievement of the Project’s objectives; and (b) afford the Bank Administrator a reasonable opportunity to exchange views with the Borrower Recipient on said plan.

Execution of the Project. (a) The Borrower declares its commitment to the objectives of the ProjectProject as set forth in Schedule 2 to this Agreement, and, to this end, shall carry out the Project through MOH with due diligence and efficiency and in conformity with appropriate financial, administrative, financialengineering, technical, irrigation and environmental and health care practices, and shall provide, promptly as needed, the funds, facilities, services and other resources required for the Project. (b) Without limitation upon the provisions of paragraph (a) of this Section and except as the Borrower and the Bank Association shall otherwise agree, the Borrower, acting through MOH, Borrower shall carry out the Project in accordance with the Implementation Program set forth in Schedule 5 4 to this Agreement. Section 3.02. Without limitation upon any of its obligations under Section 3.01 of this Agreement, the Borrower shall: (a) maintain the Project Account referred to in Section 6.01 of this Agreement, and shall replenish said account promptly every quarter with sufficient funds to enable the Borrower to meet its obligations under Section 3.01 of this Agreement for such period; (b) use the amount in said Project Account for financing the Borrower’s contribution to Project expenditures; and (c) ensure that sufficient annual allocations will be made in the Borrower’s budget for the Borrower’s counterpart contribution to the costs of the Project. Section 3.03. Except as the Bank Association shall otherwise agree, procurement of the goods, works and consultants’ services required for the Project and to be financed out of the proceeds of the Loan Credit shall be governed by the provisions of Schedule 4 3 to this Agreement, as said provisions may be further elaborated in the Procurement Plan. (b) The Borrower shall update the Procurement Plan in accordance with terms of reference acceptable to the Bank, and furnish such update to the Bank not later than twelve (12) months after the date of the preceding Procurement Plan, for the Bank’s approval. Section 3.033.04. For the purposes of Section 9.07 9.06 of the General Conditions and without limitation thereto, the Borrower shall: (a) prepare, on the basis of guidelines acceptable to the BankAssociation, and furnish to the Bank Association not later than six (6) months before after the Closing Date or such later date as may be agreed for this purpose between the Borrower, acting through MOH, Borrower and the BankAssociation, a plan for the future operation of the Project; and (b) afford the Bank Association a reasonable opportunity to exchange views with the Borrower on said plan.

Execution of the Project. (a) The Borrower Recipient declares its commitment to the objectives of the Project, Project as set forth in Schedule 2 to this Agreement and, to this end, shall carry out the Project through MOH with due diligence and efficiency and in conformity with appropriate administrative, financialfinancial engineering, technical, technical and environmental and health care practices, and shall provide, promptly as needed, the funds, facilities, services and other resources required for the Project. (b) Without limitation upon the provisions of paragraph (a) of this Section and except as the Borrower Recipient and the Bank Association shall otherwise agree, the Borrower, acting through MOH, Recipient shall carry out the Project in accordance with the Implementation Program implementation program set forth in Schedule 5 4 to this Agreement. (a) Except as the Bank Association shall otherwise agree, procurement of the goods, works and consultants’ services required for the Project and to be financed out of the proceeds of the Loan Grant shall be governed by the provisions of Schedule 4 3 to this Agreement, as said provisions may be further elaborated in the Procurement Plan. (b) The Borrower Recipient shall update the Procurement Plan in accordance with terms of reference guidelines acceptable to the BankAssociation, and furnish such update to the Bank Association not later than twelve (12) 12 months after the date of the preceding Procurement Plan, for the BankAssociation’s approval. Section 3.03. For the purposes of Section 9.07 9.06 of the General Conditions and without limitation thereto, the Borrower Recipient shall: (a) prepare, on the basis of guidelines acceptable to the BankAssociation, and furnish to the Bank Association not later than six (6) months before after the Closing Date or such later date as may be agreed for this purpose between the Borrower, acting through MOH, Recipient and the BankAssociation, a plan for the future operation of the Project; and (b) afford the Bank Association a reasonable opportunity to exchange views with the Borrower Recipient on said plan.

Execution of the Project. (a) The Borrower declares its commitment to the objectives of the Project, and, and to this end, end shall carry out the Project Project, through MOH DENR, with respect to Parts A, B, C and E of the Project, with the assistance of the Land Registration Authority with respect to Part C of the Project, and DOF with respect to Part D of the Project, all with due diligence and efficiency and in conformity with appropriate administrative, financial, technical, and land registration practices and sound environmental and health care practicessocial standards acceptable to the Bank, and shall provide, promptly as needed, the funds, facilities, services and other resources required for the execution of the Project, and shall not take or permit to be taken any action which would prevent or interfere with such performance. (b) Without limitation upon the provisions of paragraph (a) of this Section and except as the Borrower and the Bank shall otherwise agree, the Borrower, acting through MOH, Borrower shall carry out the Project in accordance with the Implementation Program set forth in Schedule 5 4 to this Agreement. (a) Except as the Bank shall otherwise agree, procurement of the goods, works and consultants’ services required for the Project and to be financed out of the proceeds of the Loan shall be governed by the provisions of Schedule 4 5 to this Agreement, as said provisions may be further elaborated in the Procurement Plan. (b) The Borrower shall update the Procurement Plan in accordance with terms of reference acceptable to the Bank, and furnish such update to the Bank not later than twelve (12) months after the date of the preceding Procurement Plan, for the Bank’s approval. Section 3.03. For the purposes of Section 9.07 of the General Conditions and without limitation thereto, the Borrower shall: (a) prepare, on the basis of guidelines acceptable to the Bank, and furnish to the Bank not later than six (6) months before after the Closing Date or such later date as may be agreed for this purpose between the Borrower, acting through MOH, Borrower and the Bank, a plan for designed to ensure the future operation continued achievement of the objectives of the Project; and (b) afford the Bank a reasonable opportunity to exchange views with the Borrower on said plan.

Execution of the Project. (a) The Borrower declares its commitment to the objectives of the Project, and, to this end, shall carry out the Project through MOH with due diligence and efficiency and in conformity with appropriate administrative, economic, engineering, financial, technicalpublic utility and technical practices, and environmental and health care practicessocial standards, and shall provide, promptly as needed, the funds, facilities, services and other resources required for the Project. (b) Without limitation upon the provisions of paragraph (a) of this Section and except as the Borrower and the Bank shall otherwise agree, the Borrower, acting through MOH, Borrower shall carry out the Project in accordance with the Implementation Program set forth in Schedule 5 to this Agreement. (a) Except as the Bank shall otherwise agree, procurement of the goods, works and consultants’ services required for the Project and to be financed out of the proceeds of the Loan shall be governed by the provisions of Schedule 4 to this Agreement, as said provisions may be further elaborated in the Procurement Plan. (b) The Borrower shall update the Procurement Plan in accordance with terms of reference guidelines acceptable to the Bank, and furnish such update to the Bank not later than twelve (12) months after the date of the preceding Procurement Plan, for the Bank’s approval. Section 3.03. For the purposes of Section 9.07 of the General Conditions and without limitation thereto, the Borrower shall: (a) prepare, on the basis of guidelines acceptable to the Bank, and furnish to the Bank not later than six (6) months before after the Closing Date or such later date as may be agreed for this purpose between the Borrower, acting through MOH, Borrower and the Bank, a plan for designed to ensure the future operation continued achievement of the ProjectProject objectives; and (b) afford the Bank a reasonable opportunity to exchange views with the Borrower on said plan.

Execution of the Project. (a) The Borrower declares its commitment to the objectives of the ProjectProject as set forth in Schedule 2 to this Agreement, and, to this end, shall carry out the Project through MOH with due diligence and efficiency and in conformity with appropriate administrative, financial, technical, environmental health and health care technical practices, and shall provide, promptly as needed, the funds, facilities, services and other resources required for the Project. (b) Without limitation upon the provisions of paragraph (a) of this Section and except as the Borrower and the Bank Association shall otherwise agree, the Borrower, acting through MOH, Borrower shall carry out the Project in accordance with the Implementation Program set forth in Schedule 5 4 to this Agreement. (a) Section 3.02. Except as the Bank Association shall otherwise agree, procurement of the goods, works and consultants’ services required for the Project and to be financed out of the proceeds of the Loan Credit shall be governed by the provisions of Schedule 4 3 to this Agreement, as said provisions may be further elaborated in the Procurement Plan. (b) The Borrower shall update the Procurement Plan in accordance with terms of reference acceptable to the Bank, and furnish such update to the Bank not later than twelve (12) months after the date of the preceding Procurement Plan, for the Bank’s approval. Section 3.03. The Borrower shall: (i) establish and thereafter maintain in Nakfa, until completion of the Project, a Project Account in a commercial bank on terms and conditions satisfactory to the Association into which the Borrower shall deposit its counterpart contributions to Project costs; (ii) pay into the Project Account an initial amount (the Initial Deposit) equivalent to $350,000; and (iii) thereafter during each following quarter deposit into the Project Account the amounts required to cover the said contributions for each such quarter, as determined by the Borrower and the Association. Section 3.04. For the purposes of Section 9.07 9.06 of the General Conditions and without limitation thereto, the Borrower shall: (a) prepare, on the basis of guidelines acceptable to the BankAssociation, and furnish to the Bank Association not later than six (6) months before after the Closing Date or such later date as may be agreed for this purpose between the Borrower, acting through MOH, Borrower and the BankAssociation, a plan for the future operation of the Project; and (b) afford the Bank Association a reasonable opportunity to exchange views with the Borrower on said plan.

Execution of the Project. (a) The Borrower declares its commitment to the objectives of the ProjectProject as set forth in Schedule 2 to this Agreement, and, to this end, shall carry out out, through MPW, the Project through MOH with due diligence and efficiency and in conformity with appropriate administrative, financial, technicalengineering and land management practices, and social and environmental and health care practicesstandards acceptable to the Bank, and shall provide, promptly as needed, the funds, facilities, services and other resources required for the Project. (b) Without limitation upon the provisions of paragraph (a) of this Section and except as the Borrower and the Bank shall otherwise agree, the Borrower, acting through MOH, Borrower shall carry out the Project in accordance with the Implementation Program set forth in Schedule 5 to this Agreement. (a) Except as the Bank shall otherwise agree, procurement of the goods, works and consultants’ services required for the Project and to be financed out of the proceeds of the Loan and the PHRD Grant shall be governed by the provisions of Schedule 4 to this Agreement, as said provisions may be further elaborated in the Procurement Plan. (b) The Borrower shall update the Procurement Plan in accordance with terms of reference acceptable to the Bank, and furnish such update it to the Bank not later than twelve (12) months after the date of the preceding Procurement Plan, for the Bank’s approval. Section 3.03. For the purposes of Section 9.07 of the General Conditions and without limitation thereto, the Borrower shall: (a) prepare, on the basis of guidelines acceptable to the Bank, and furnish to the Bank not later than six (6) months before after the Closing Date or such later date as may be agreed for this purpose between the Borrower, acting through MOH, Borrower and the Bank, a plan for designed to ensure the future operation continued achievement of the Project’s objectives; and (b) afford the Bank a reasonable opportunity to exchange views with the Borrower on said plan.

Execution of the Project. (a) The Borrower declares its commitment to the objectives of the Project, and, to this end, shall carry out the Project Project, through MOH the Department of Agriculture, with due diligence and efficiency and in conformity with appropriate agricultural, administrative, financialeconomic, technicalengineering, financial and managerial practices and sound social and environmental and health care practicesstandards acceptable to the Bank, and shall provide, promptly as needed, the funds, facilities, services and other resources required for the Project. (b) Without limitation upon the provisions of paragraph (a) of this Section and except as the Borrower and the Bank shall otherwise agree, the Borrower, acting through MOH, Borrower shall carry out the Project in accordance with the Implementation Program set forth in Schedule 5 to this Agreement. (a) Except as the Bank shall otherwise agree, procurement of the goods, works and consultants’ services required for the Project and to be financed out of the proceeds of the Loan shall be governed by the provisions of Schedule 4 to this Agreement, as said provisions may be further elaborated in the Procurement Plan. (b) The Borrower Borrower, through DA, shall update the Procurement Plan in accordance with terms of reference acceptable to the Bank, and furnish such update to the Bank not later than twelve (12) 12 months after the date of the preceding Procurement Plan, for the Bank’s approval. Section 3.03. For the purposes of Section 9.07 of the General Conditions and without limitation thereto, the Borrower shall: (a) prepare, on the basis of guidelines acceptable to the Bank, and furnish to the Bank not later than six (6) months before after the Closing Date or such later date as may be agreed for this purpose between the Borrower, acting through MOH, Borrower and the Bank, a plan for the future operation of the Project; and (b) afford the Bank a reasonable opportunity to exchange views with the Borrower on said plan.

Execution of the Project. (a) The Borrower declares its commitment to the objectives of the ProjectProject as set forth in Schedule 2 to this Agreement, and, to this end, shall carry out the Project through MOH with due diligence and efficiency and in conformity with appropriate administrative, financial, technicalengineering, environmental and health care public utility practices, and shall provide, or cause to be provided, promptly as needed, the funds, facilities, services and other resources required for the Project. (b) Without limitation upon the provisions of paragraph (a) of this Section and except as the Borrower Bank and the Bank Borrower shall otherwise agree, the Borrower, acting through MOH, Borrower shall carry out the Project in accordance with the Implementation Program set forth in Schedule 5 to this Agreement. (a) Section 3.02. Except as the Bank shall otherwise agree, procurement of the goods, works goods and consultants’ services required for the Project and to be financed out of the proceeds of the Loan shall be governed by the provisions of Schedule 4 to this Agreement, as said provisions may be further elaborated in the Procurement Plan. (b) The Borrower shall update the Procurement Plan in accordance with terms of reference acceptable to the Bank, and furnish such update to the Bank not later than twelve (12) months after the date of the preceding Procurement Plan, for the Bank’s approval. Section 3.03. For the purposes of Section 9.07 of the General Conditions and without limitation thereto, the The Borrower shall: : (a) prepare, on the basis following an exchange of guidelines acceptable to views with the Bank, and furnish to the Bank not later than six (6) months before Bank, by October 31 in each year, a CPP for the Closing Date or such later date as may be agreed for this purpose between following fiscal year of the Borrower, acting through MOHwhich shall set forth, in a manner consistent with the Borrower’s obligations under this Agreement: (i) the generation and transmission system expansion targets for the Borrower, including the components of the capital expenditures program to be carried out during the concerned fiscal year and the Bank, a plan investments under such components to be financed from the proceeds of the Loan; (ii) the financial targets for the future operation of the Project; and (b) afford the Bank Borrower, including a reasonable opportunity to exchange views with financial projection showing whether the Borrower on said plan.would comply with its obligations under Section 5.03 (a) of this Agreement; and (iii) the Borrower’s levels of services, borrowing needs, financing plan and tariff levels and structures;

Execution of the Project. (a) The Borrower declares its commitment to the objectives of the Project, and, to this end, shall carry out Parts A (other than Parts A.2 (a), A.4 (a)), B, C.2, C.3 and D of the Project through MOH MOF, Parts A.2 (a) and A.4 (a) through BAPPENAS, and Part C.1 of the Project through the Office of the Secretary General of the DPR, in each case with due diligence and efficiency and in conformity with appropriate administrative, financialmanagement, technical, environmental financial and health care budgetary practices, and shall provide, promptly as needed, the funds, facilities, services and other resources required for the Project. (b) Without limitation upon the provisions of paragraph (a) of this Section and except as the Borrower and the Bank shall otherwise agree, the Borrower, acting through MOH, Borrower shall carry out the Project in accordance with the Implementation Program set forth in Schedule 5 to this Agreement. (a) Except as the Bank shall otherwise agree, procurement of the goods, works and consultants’ services required for the Project and to be financed out of the proceeds of the Loan shall be governed by the provisions of Schedule 4 to this Agreement, as said provisions may be further elaborated in the Procurement Plan. (b) The Borrower shall update the Procurement Plan in accordance with terms of reference guidelines acceptable to the Bank, and furnish such update to the Bank not later than twelve (12) months after the date of the preceding Procurement Plan, for the Bank’s approval. Section 3.03. For the purposes of Section 9.07 of the General Conditions and without limitation thereto, the Borrower shall: (a) prepare, on the basis of guidelines acceptable to the Bank, and furnish to the Bank not later than six (6) months before the Closing Date or such later date as may be agreed for this purpose between the Borrower, acting through MOH, Borrower and the Bank, a plan designed for the future operation continued achievement of the Project’s objectives; and (b) afford the Bank a reasonable opportunity to exchange views with the Borrower on said plan.

Execution of the Project. (a) The Borrower Recipient declares its commitment to the objectives of the ProjectProject as set forth in Schedule 2 to this Agreement, and, to this end, shall carry out the Project through MOH with due diligence and efficiency and in conformity with appropriate administrative, financial, technical, environmental financial and public health care practices, and shall provide, promptly as needed, the funds, facilities, services and other resources required for the Project. (b) Without limitation upon the provisions of paragraph (a) of this Section and except as the Borrower Recipient and the Bank Association shall otherwise agree, the Borrower, acting through MOH, Recipient shall carry out the Project in accordance with the Implementation Program set forth in Schedule 5 4 to this Agreement. (a) Except as the Bank Association shall otherwise agree, procurement of the goods, works and consultants’ services required for the Project and to be financed out of the proceeds of the Loan Grant shall be governed by the provisions of Schedule 4 3 to this Agreement, as said provisions may be further elaborated in the Procurement Plan. (b) The Borrower Recipient shall update the Procurement Plan in accordance with terms of reference guidelines acceptable to the BankAssociation, and furnish such update to the Bank Association not later than twelve (12) 12 months after the date of the preceding Procurement Plan, for the BankAssociation’s approval. Section 3.03. For the purposes of Section 9.07 9.06 of the General Conditions and without limitation thereto, the Borrower Recipient shall: (a) prepare, on the basis of guidelines acceptable to the BankAssociation, and furnish to the Bank Association not later than six (6) months before the Closing Date or such later date as may be agreed for this purpose between the Borrower, acting through MOH, Recipient and the BankAssociation, a plan for the future operation of the Project; and (b) afford the Bank Association a reasonable opportunity to exchange views with the Borrower Recipient on said plan.

Execution of the Project. (a) The Borrower declares its commitment to the objectives of the Project, and, to this end, shall carry out the Project through MOH the CEE for Part A of the Project, the MOE for Part B of the Project, and the PMU for Part C of the Project with due diligence and efficiency and in conformity with appropriate technical, engineering, administrative, financial, technicalenvironmental, environmental health and health care safety practices, and shall provide, promptly as needed, the funds, facilities, services and other resources required for the Project. (b) Without limitation upon the provisions of paragraph (a) of this Section and except as the Borrower and the Bank shall otherwise agree, the Borrower, acting through MOH, Borrower shall carry out the Project in accordance with the Implementation Program set forth in Schedule 5 to this Agreement. (a) Except as the Bank shall otherwise agree, procurement of the goods, works and consultants’ services required for the Project and to be financed out of the proceeds of the Loan shall be governed by the provisions of Schedule 4 to this Agreement, as said provisions may be further elaborated in the Procurement Plan. (b) The Borrower shall update the Procurement Plan in accordance with terms of reference guidelines acceptable to the Bank, and furnish such update to the Bank not later than twelve (12) 12 months after the date of the preceding Procurement Plan, for the Bank’s approval. Section 3.03. For the purposes of Section 9.07 of the General Conditions and without limitation thereto, the Borrower shall: (a) prepare, on the basis of guidelines acceptable to the Bank, and furnish to the Bank not later than six (6) months before after the Closing Date or such later date as may be agreed for this purpose between the Borrower, acting through MOH, Borrower and the Bank, a plan for designed to ensure the future operation sustainability of the Project; and (b) afford the Bank a reasonable opportunity to exchange views with the Borrower on said plan.

Execution of the Project. (a) The Borrower declares its commitment to the objectives of the Project, and, to this end, : (i) shall carry out Parts A and C of the Project through MOH DECS; (ii) shall carry out Parts B and C of the Project through DSWD; and (iii) shall carry out Part C of the Project through DBM, in collaboration with COA, with due diligence and efficiency and in conformity with appropriate administrative, economic, educational, environmental, financial, technical, environmental procurement and health care practices, management practices and shall provide, promptly as needed, the funds, facilities, services and other resources required for the Project. DBM and COA will provide oversight for the implementation of Parts A and B of the Project. (b) Without limitation upon the provisions of paragraph (a) of this Section and except as the Borrower and the Bank shall otherwise agree, the Borrower, acting through MOH, Borrower shall carry out the Project in accordance with the Implementation Program set forth in Schedule 5 to this Agreement. (a) Section 3.02. Except as the Bank shall otherwise agree, procurement of the goods, works and consultants’ services required for the Project and to be financed out of the proceeds of the Loan shall be governed by the provisions of Schedule 4 to this Agreement, as said provisions may be further elaborated in the Procurement Plan. (b) The Borrower shall update the Procurement Plan in accordance with terms of reference acceptable to the Bank, and furnish such update to the Bank not later than twelve (12) months after the date of the preceding Procurement Plan, for the Bank’s approval. Section 3.03. For the purposes of Section 9.07 9.08 of the General Conditions and without limitation thereto, the Borrower shall: (a) prepare, on the basis of guidelines acceptable to the Bank, and furnish to the Bank not later than six (6) months before after the Closing Date or such later date as may be agreed for this purpose between the Borrower, acting through MOH, Borrower and the Bank, a plan for the future operation continued achievement of the purposes of the Project; and (b) afford the Bank a reasonable opportunity to exchange views with the Borrower on said plan.

Execution of the Project. (a) The Borrower declares its commitment to the objectives of the Project, and, to this end, shall carry out the Project through MOH its Ministry of Railways with due diligence and efficiency and in conformity with appropriate administrative, financial, technicalengineering, and railways practices, and social and environmental and health care practicesstandards, and shall provide, promptly as needed, the funds, facilities, services and other resources required for the Project. (b) Without limitation upon the provisions of paragraph (a) of this Section and except as the Borrower and the Bank shall otherwise agree, the Borrower, acting through MOH, Borrower shall carry out the Project in accordance with the Implementation Program set forth in Schedule 5 to this Agreement. (a) Except as the Bank shall otherwise agree, procurement of the goods, works goods and consultants’ services required for the Project and to be financed out of the proceeds of the Loan shall be governed by the provisions of Schedule 4 to this Agreement, as said provisions may be further elaborated in the Procurement Plan. (b) The Borrower shall update the Procurement Plan in accordance with terms of reference guidelines acceptable to the Bank, and furnish such update to the Bank not later than twelve (12) 12 months after the date of the preceding Procurement Plan, for the Bank’s approval. Section 3.03. For the purposes of Section 9.07 of the General Conditions and without limitation thereto, the Borrower shall: (a) prepare, on the basis of guidelines acceptable to the Bank, and furnish to the Bank not later than six (6) months before after the Closing Date or such later date as may be agreed for this purpose between the Borrower, acting through MOH, Borrower and the Bank, a plan for the future operation continued achievement of the objectives of the Project; and (b) afford the Bank a reasonable opportunity to exchange views with the Borrower on said plan.

Execution of the Project. (a) The Borrower declares its commitment to the objectives of the Project, and, to this end, shall carry out the Project Project, through MOH MAI (Part A), MTCT (Part B), MEWM (Part C) and NAMR (Part D), with due diligence and efficiency and in conformity with appropriate administrative, financialtechnical, technicalengineering, environmental and health care financial practices, and shall provide, promptly as needed, the funds, facilities, services and other resources required for the Project. (b) Without limitation upon the provisions of paragraph (a) of this Section and except as the Borrower and the Bank shall otherwise agree, the Borrower, acting through MOHMAI, MTCT, MEWM and NAMR, shall carry out the Project in accordance with the Implementation Program set forth in Schedule 5 to this Agreement. (a) Except as the Bank shall otherwise agree, procurement of the goods, works and consultants’ services required for the Project and to be financed out of the proceeds of the Loan shall be governed by the provisions of Schedule 4 to this Agreement, as said provisions may be further elaborated in the Procurement Plan. (b) The Borrower shall update the Procurement Plan procurement plan in accordance with terms of reference acceptable to the Bank, and furnish such update to the Bank not later than twelve (12) months after the date of the preceding Procurement Planprocurement plan, for the Bank’s approval. Section 3.03. For the purposes of Section 9.07 of the General Conditions and without limitation thereto, the Borrower shall: (a) prepare, on the basis of guidelines acceptable to the Bank, and furnish to the Bank not later than six (6) months before after the Closing Date or such later date as may be agreed for this purpose between the Borrower, acting through MOH, Borrower and the Bank, a plan for designed to ensure the future operation continued achievement of the Project’s objectives; and (b) afford the Bank a reasonable opportunity to exchange views with the Borrower on said plan.

Execution of the Project. (a) The Borrower Recipient declares its commitment to the objectives of the Project, Project as set forth in Schedule 2 to this Agreement and, to this end, without any limitation or restriction upon any of its other obligations under the Global Environment Facility Trust Fund Grant Agreement, shall carry out cause CENAGREF to perform, in accordance with the provisions of the Project through MOH with due diligence Agreement, all the obligations of CENAGREF therein set forth, shall take and efficiency and in conformity with appropriate administrativecause to be taken all action, financial, technical, environmental and health care practices, and shall provide, promptly as needed, including the provision of funds, facilities, services and other resources required for the Projectresources, necessary or appropriate to enable CENAGREF to perform such obligations and shall not take or permit to be taken any action which would prevent or interfere with such performance. (b) Without limitation upon the provisions of paragraph (a) of this Section Section, and except as the Borrower Recipient and the Bank shall otherwise agree, the Borrower, acting through MOH, Recipient shall carry assist CENAGREF in the carrying out of the Project in accordance with the Implementation Program set forth in Schedule 5 3 to this Agreement. (a) Section 3.02. Except as the Bank shall otherwise agree, procurement of the goods, works and consultants’ services required for the Project and to be financed out of the proceeds of the Loan GEF Trust Fund Grant shall be governed by the provisions of Schedule 4 to this Agreement, as said provisions may be further elaborated in the Procurement Plan. (b) The Borrower shall update the Procurement Plan in accordance with terms of reference acceptable 1 to the Bank, and furnish such update to the Bank not later than twelve (12) months after the date of the preceding Procurement Plan, for the Bank’s approvalProject Agreement. Section 3.03. For the purposes of Section 9.07 of the General Conditions and without limitation thereto, the Borrower shallRecipient shall take steps, or cause CENAGREF to take steps, to: (a) prepare, on the basis of guidelines acceptable to the Bank, and furnish to the Bank not later than six (6) months before after the Closing Date or such later date as may be agreed for this purpose between the Borrower, acting through MOH, Recipient and the Bank, a plan for plan, of such scope and in such detail as the future operation Bank shall reasonably request, designed to ensure the continued achievement of the Project; and (b) afford the Bank a reasonable opportunity to exchange views with the Borrower Recipient on said plan. Section 3.04. The Recipient and the Bank hereby agree that the obligations set forth in Sections 9.04, 9.05, 9.06, 9.07 and 9.08 of the General Conditions (relating to insurance, use of goods and services, plans and schedules, records and reports, and maintenance, respectively) shall be carried out by CENAGREF pursuant to Section 2.03 of the Project Agreement. (a) The Recipient shall conclude an agreement (hereinafter referred to as the Convention) with CENAGREF, under which it shall transfer to CENAGREF the entire proceeds of the GEF Trust Fund Grant on an non-reimbursable basis and on such other terms and conditions as shall be acceptable to the Bank, including, but without being limited to, the provisions set forth in Part A of Schedule 3 to this Agreement. (b) The Recipient shall exercise its rights under the Convention in such manner as to protect the interests of the Recipient and the Bank and to accomplish the purposes of the GEF Trust Fund Grant, and except as the Bank shall otherwise agree, the Recipient shall not assign, amend, abrogate or waive the Convention or any provision thereof.

Execution of the Project. (a) The Borrower declares its commitment to the objectives of the ProjectProject as set forth in Schedule 2 to this Agreement, and, to this end, shall carry out the Project through MOH MOA with due diligence and efficiency and in conformity with appropriate administrative, financial, technical, technical and environmental and health care practices, and shall provide, promptly as needed, the funds, facilities, services and other resources required for the Project. (b) Without limitation upon the provisions of paragraph (a) of this Section and except as the Borrower and the Bank Association shall otherwise agree, the Borrower, acting through MOH, Borrower shall carry out the Project in accordance with the Implementation Program set forth in Schedule 5 4 to this Agreement. (a) Except as the Bank Association shall otherwise agree, procurement of the goods, works and consultants’ services required for the Project and to be financed out of the proceeds of the Loan Credit shall be governed by the provisions of Schedule 4 3 to this Agreement, as said provisions may be further elaborated in the Procurement Plan. (b) The Borrower shall update the Procurement Plan in accordance with terms of reference guidelines acceptable to the BankAssociation, and furnish such update to the Bank Association not later than twelve (12) months after the date of the preceding Procurement Plan, for the BankAssociation’s approval. Section 3.03. For the purposes of Section 9.07 9.06 of the General Conditions and without limitation thereto, the Borrower shall: (a) prepare, on the basis of guidelines acceptable to the BankAssociation, and furnish to the Bank Association not later than six (6) months before after the Closing Date or such later date as may be agreed for this purpose between the Borrower, acting through MOH, Borrower and the BankAssociation, a plan for the future operation of the Project; and (b) afford the Bank Association a reasonable opportunity to exchange views with the Borrower on said plan.

Execution of the Project. (a) The Borrower Recipient declares its commitment to the objectives of the Project, Project as set forth in Schedule 2 to this Agreement and, to this end, shall carry out the Project through MOH MOA with due diligence and efficiency and in conformity with appropriate administrative, financialfinancial and technical practices, technical, and with due regard to ecological and environmental and health care practicesfactors, and shall provide, promptly as needed, the funds, facilities, services and other resources required for the Project. (b) Without limitation upon the provisions of paragraph (a) of this Section and except as the Borrower Recipient and the Bank shall otherwise agree, the Borrower, acting through MOH, Recipient shall carry out the Project in accordance with the Implementation Program set forth in Schedule 5 4 to this Agreement. (a) Except as the Bank shall otherwise agree, procurement of the goods, works and consultants’ services required for the Project and to be financed out of the proceeds of the Loan GEF Trust Fund Grant shall be governed by the provisions of Schedule 4 3 to this Agreement, as said provisions may be further elaborated in the Procurement Plan. (b) The Borrower Recipient shall update the Procurement Plan in accordance with terms of reference guidelines acceptable to the Bank, and furnish such update to the Bank not later than twelve (12) months after the date of the preceding Procurement Plan, for the Bank’s approval. Section 3.03. For the purposes of Section 9.07 9.08 of the General Conditions and without limitation thereto, the Borrower Recipient shall: (a) prepare, on the basis of guidelines acceptable to the Bank, and furnish to the Bank not later than six (6) months before after the Closing Date or such later date as may be agreed for this purpose between the Borrower, acting through MOH, Recipient and the Bank, a plan for the future operation of the Project; and (b) afford the Bank a reasonable opportunity to exchange views with the Borrower Recipient on said plan.

Execution of the Project. (a) The Borrower declares its commitment to the objectives of the Project, and, to this end, shall carry out the Project through MOH MoSES with due diligence and efficiency and in conformity with appropriate administrative, financial, technical, educational and environmental and health care practices, and shall provide, promptly as needed, the funds, facilities, services and other resources required for the Project. (b) Without limitation upon the provisions of paragraph (a) of this Section and except as the Borrower and the Bank shall otherwise agree, the BorrowerBorrower shall, acting through MOHMoSES, shall carry out the Project in accordance with the Implementation Program set forth in Schedule 5 to this AgreementAgreement and with the Operational Manual. (a) Except as the Bank shall otherwise agree, procurement of the goods, works and consultants’ services required for the Project and to be financed out of the proceeds of the Loan shall be governed by the provisions of Schedule 4 to this Agreement, as said provisions may be further elaborated in the Procurement Plan. (b) The Borrower Borrower, through MoSES, shall update the Procurement Plan in accordance with terms of reference acceptable to guidelines agreed upon between MoSES and the Bank, and furnish such update updates to the Bank not later than twelve (12) months after at the date of the preceding Procurement Plan, same time when a respective ADP shall be submitted for the Bank’s approvalapproval pursuant to the provisions of paragraph 3 of Schedule 5 to this Agreement. Section 3.03. For the purposes of Section 9.07 of the General Conditions and without limitation thereto, the Borrower Borrower, through MoSES, shall: (a) prepare, on the basis of guidelines acceptable to the Bank, and furnish to the Bank not later than six two (62) months before after the Closing Date or such later date as may be agreed for this purpose between the Borrower, acting through MOH, Borrower and the Bank, a plan for designed to ensure the future operation continued achievement of the Project’s objectives; and (b) afford the Bank a reasonable opportunity to exchange views with the Borrower on said plan.

Execution of the Project. (a) The Borrower Recipient declares its commitment to the objectives of the Project, Project as set forth in Schedule 2 to this Agreement and, to this end, without any limitation or restriction upon any of its other obligations under this Agreement, shall carry out the Project through MOH with due diligence and efficiency and in conformity with appropriate administrative, financial, technical, environmental administrative and health care financial practices, and shall provide, promptly as needed, the funds, facilities, services and other resources required for the Project. (b) Without limitation upon the provisions of paragraph (a) of this Section and except as the Borrower Recipient and the Bank Association shall otherwise agree, the Borrower, acting through MOH, Recipient shall carry out the Project in accordance with the Implementation Program implementation program set forth in Schedule 5 4 to this Agreement. (a) Except as the Bank Association shall otherwise agree, procurement of the goods, works goods and consultants’ services required for the Project and to be financed out of the proceeds of the Loan Grant shall be governed by the provisions of Schedule 4 3 to this Agreement, as said provisions may be further elaborated in the Procurement Plan. (b) The Borrower Recipient shall update the Procurement Plan in accordance with terms of reference guidelines acceptable to the BankAssociation, and furnish such update to the Bank Association not later than twelve four (124) months after the date of the preceding Procurement Plan, for the BankAssociation’s approval. Section 3.03. For the purposes of Section 9.07 9.06 of the General Conditions and without limitation thereto, the Borrower Recipient shall: (a) : prepare, on the basis of guidelines acceptable to the BankAssociation, and furnish to the Bank Association not later than six (6) months before after the Closing Date or such later date as may be agreed for this purpose between the Borrower, acting through MOH, Recipient and the BankAssociation, a plan for designed to ensure the future operation continued achievement of the Project’s objectives; and (b) afford the Bank a reasonable opportunity to exchange views with the Borrower on said plan.

Execution of the Project. (a) The Borrower declares its commitment to the objectives of the Project, and, to this end, shall carry out the Project through MOH with due diligence and efficiency and in conformity with appropriate administrative, financial, technical, environmental and health care practices, and shall provide, promptly as needed, the funds, facilities, services and other resources required for the Project.the (b) Without limitation upon the provisions of paragraph (a) of this Section and except as the Borrower and the Bank Association shall otherwise agree, the Borrower, acting through MOH, Borrower shall carry out the Project through OVPM, in accordance with the Implementation Program set forth in Schedule 5 4 to this Agreement. (a) Section 3.02. Except as the Bank Association shall otherwise agree, procurement of the goods, works goods and consultants’ services required for the Project and to be financed out of the proceeds of the Loan Credit shall be governed by the provisions of Schedule 4 3 to this Agreement, as said provisions may be further elaborated in the Procurement Plan. (b) The Borrower shall update the Procurement Plan in accordance with terms of reference acceptable to the Bank, and furnish such update to the Bank not later than twelve (12) months after the date of the preceding Procurement Plan, for the Bank’s approval. Section 3.03. For the purposes of Section 9.07 of the General Conditions and without limitation thereto, the Borrower shall: (a) prepare, on the basis of guidelines acceptable to the Bank, Association and furnish to the Bank Association not later than six (6) months before the after th+e Closing Date or such later date as may be agreed for this purpose between the Borrower, acting through MOH, Borrower and the BankAssociation, a plan for designed to ensure the future operation continued achievement of the Project’s objectives; and (b) afford the Bank Association a reasonable opportunity to exchange views with the Borrower on said plan. Section 3.04. Without limitation to its obligations under Section 3.01 of this Agreement, the Borrower shall: (a) open and maintain an account (the Project Account) in C.V. Esc. in BCV on terms and conditions satisfactory to the Association; (b) promptly thereafter, make an initial deposit into such account, in an amount equivalent to US$50,000, to finance the Borrower's contribution to the Project; (c) deposit into the Project Account by January 15, April 15, July 15 and October 15 in each year, until the completion of the Project, such amounts as shall be required to replenish in a timely manner the Project Account to equal the amount of the initial deposit referred to in paragraph (b) above; and (d) use the Project Account funds exclusively to finance expenditures under the Project.

Execution of the Project. (a) The Borrower declares its commitment to the objectives of the Project, and, to this end, shall carry out the Project through MOH the Project Implementing Agencies with due diligence and efficiency and in conformity with appropriate administrativeengineering, financialenvironmental, technical, environmental administrative and health care financial practices, and shall provide, promptly as needed, the funds, facilities, services and other resources required for the Project. (b) Without limitation upon the provisions of paragraph (a) of this Section and except as the Borrower and the Bank shall otherwise agree, the Borrower, acting through MOH, Borrower shall carry out the Project in accordance with the Implementation Program set forth in Schedule 5 to this Agreement. (a) Except as the Bank shall otherwise agree, procurement of the goods, works and consultants’ services required for the Project and to be financed out of the proceeds of the Loan shall be governed by the provisions of Schedule 4 to this Agreement, as said provisions may be further elaborated in the Procurement Plan. (b) The Borrower shall update the Procurement Plan in accordance with terms of reference guidelines acceptable to the Bank, and furnish such update to the Bank not later than twelve (12) months after the date of the preceding Procurement Plan, for the Bank’s approval. Section 3.03. For the purposes of Section 9.07 of the General Conditions and without limitation thereto, the Borrower shall: (a) prepare, on the basis of guidelines acceptable to the Bank, and furnish to the Bank not later than six (6) months before after the Closing Date or such later date as may be agreed for this purpose between the Borrower, acting through MOH, Borrower and the Bank, a plan for the future operation continued achievement of the objectives of the Project; and (b) and afford the Bank a reasonable opportunity to exchange views with the Borrower on said plan.

Execution of the Project. (a) The Borrower CGIC declares its commitment to the objectives of the ProjectProject as set forth in Schedule 2 to the Loan Agreement, and, to this end, shall carry out Part C of the Project through MOH with due diligence and efficiency and in conformity with appropriate administrative, financial, technical, environmental administrative and health care financial practices, and shall provide, promptly as needed, the funds, facilities, services and other resources required for the Project. (b) Without limitation upon the provisions of paragraph (a) of this Section and except as the Borrower Borrower, Bank and the Bank CGIC shall otherwise agree, the Borrower, acting through MOH, CGIC shall carry out Part C of the Project in accordance with the Implementation Program set forth in the Schedule 5 to this Agreement. Section 2.02. Without limitation upon the provisions of paragraph (a) Except as the Bank shall otherwise agreeof this Section, procurement of the goodsCGIC, works and consultants’ services required for the Project and to be financed out of the proceeds of the Loan shall be governed by the provisions of Schedule 4 to this Agreement, as said provisions may be further elaborated in the Procurement Plan. (b) The Borrower shall update the Procurement Plan in accordance with terms of reference acceptable to the Bank, and furnish such update to the Bank not later than twelve (12) months after the date of the preceding Procurement Plan, for the Bank’s approval. Section 3.03. For the purposes of Section 9.07 of the General Conditions and without limitation thereto, the Borrower shall: (a) prepare, on the basis of guidelines acceptable to the Bank, Borrower and the Bank and furnish to the Borrower and the Bank not later than six (6) months before after the Closing Date or such later date as may be agreed for this purpose between the Borrower, acting through MOH, Bank and the BankCGIC, a plan for the future operation continued achievement of the objectives of Part C of the Project; and (b) afford the Borrower and the Bank a reasonable opportunity to exchange views with the Borrower CGIC on said plan. Section 2.03. CGIC shall duly perform all its obligations under the Subsidiary Agreement. Except as the Borrower and Bank shall otherwise agree, CGIC shall not take or concur in any action which would have the effect of amending, abrogating, assigning or waiving the Subsidiary Agreement or any provision thereof. Section 2.04. (a) CGIC shall, at the request of the Borrower and Bank, exchange views with the Borrower and the Bank with regard to the progress of Part C of the Project, the performance of its obligations under this Agreement and under the Subsidiary Agreement, and other matters relating to the purposes of the Loan.

Execution of the Project. (a) The Borrower declares its commitment to the objectives of the Project, and, to this end, shall carry out the Project through MOH with due diligence and efficiency and in conformity with appropriate administrative, financial, technical, environmental engineering, transport, environmental, social, administrative and health care financial practices, and shall provide, promptly as needed, the funds, facilities, services and other resources required for the Project. (b) Without limitation upon the provisions of paragraph (a) of this Section and except as the Borrower and the Bank shall otherwise agree, the Borrower, acting through MOH, Borrower shall carry out the Project in accordance with the Implementation Program set forth in Schedule 5 to this Agreement, the Project Implementation Plan, the Environmental Assessment Procedures, the EMP and the Land Acquisition and Resettlement Policy Framework. (a) Except as the Bank shall otherwise agree, procurement of the goods, works and consultants’ services required for the Project and to be financed out of the proceeds of the Loan shall be governed by the provisions of Schedule 4 to this Agreement, as said provisions may be further elaborated in the Procurement Plan. (b) The Borrower shall update the Procurement Plan in accordance with terms of reference acceptable to the Bank, and furnish such update to the Bank not later than twelve (12) 12 months after the date of the preceding Procurement Plan, for the Bank’s approval. Section 3.03. For the purposes of Section 9.07 of the General Conditions and without limitation thereto, the Borrower shall: (a) prepare, on the basis of guidelines acceptable to the Bank, and furnish to the Bank not later than six (6) months before after the Closing Date or such later date as may be agreed for this purpose between the Borrower, acting through MOH, Borrower and the Bank, a plan for the future operation of the Project; and (b) afford the Bank a reasonable opportunity to exchange views with the Borrower on said plan.
