EXECUTIVE'S CURRENT CAPABILITIES. The parties acknowledge and agree that the Executive is physically and mentally capable of performing the duties required by this Agreement and that any physical or mental disabilities that he may have at the present time are not deemed by the Company to be disabling, as defined in this Agreement, as such disabilities may presently exist and affect the Executive's mental and physical condition.
