Common use of Expansion of Capacity Clause in Contracts

Expansion of Capacity. The Utility will take reasonable steps, at Licensee’s sole expense, to expand Pole Capacity when necessary to accommodate Licensee’s request for Attachment. Notwithstanding the foregoing sentence, nothing in this Agreement shall be construed to require the Utility to install, retain, extend or maintain any Pole for use when such Pole is not needed for the Utility’s service requirements.
