Common use of Expansion of Capacity Clause in Contracts

Expansion of Capacity. District will take reasonable steps to expand, at Licensee’s sole expense, its Pole/Conduit System Capacity when necessary to accommodate Licensee’s request for Attachment. Notwithstanding the foregoing sentence, nothing in this Agreement shall be construed to require District to install, retain, extend or maintain any Pole or portion of the Conduit System for use when such Pole/Conduit System is not needed for District’s service requirements.
