Common use of Expansion of Service Clause in Contracts

Expansion of Service. Concord agrees to provide water service to new and expanded uses on the parcels within Concord’s 2A Service Area in Acton that do not front Acton Water District’s water distribution system up to a total commitment not to exceed of 61,000 gallons per day for the combined demand from existing, new, and expanded uses in Acton, as reflected in Exhibit B, so long as: i. All existing water withdrawal rights established by Concord from Nagog Pond are maintained, and, to the extent required, Concord receives commensurate authorization for any such increased demand in Concord’s 2A Service Area in subsequent Water Management Act permit renewals. ii. The proponent of such new or expanded use, in accordance with Concord’s Rules and Regulations Governing Water Use and Connections (as amended), (1) files an application for water service with the Concord Public Works Water/Sewer Division that includes a water demand impact analysis and Concord concludes that such proposed new or expanded use, including any approved demand mitigation requirements, will not compromise service to existing customers or exceed Concord’s ability to supply said capacity, and (2) following completion of construction, provides Concord Public Works Water/Sewer Division an affidavit demonstrating the approved demand mitigation requirements have been implemented prior to Concord activating the water service.
