Extension of Restrictions. If the Executive violates the provisions of Section 4.1(a) or Section 4.1(b), the twelve (12) or twenty-four (24) month period referred to in Section 4.1(a) or Section 4.1(b), as applicable, shall recommence and the Executive shall continue to be bound by the restrictions set forth in Section 4.1 until a period of twelve (12) or twenty-four (24) months, as applicable, has expired without any violation of such provisions. Further, the twelve (12) month period set forth in Section 4.1(a) may be extended to a period of twenty-four (24) months following the cessation of the Executive’s employment if the Executive has breached any fiduciary duty to the Company or the Executive has unlawfully taken, physically or electronically, property belonging to the Company.
