Common use of Facility Condition Clause in Contracts

Facility Condition. Except as disclosed to First Mortgage Lender in connection with its making of the First Mortgage Loan, the Facility is in good and habitable condition and there are no deficiencies in the repair or maintenance of the Property that threaten the health or safety of its residents and their invited guests. There is no material uncured violation at the Property of any building or housing code or similar law or ordinance, and the physical configuration of the Property is not in material violation of the Americans With Disabilities Act.
