Common use of Failure of Allottee to Clause in Contracts

Failure of Allottee to. take Possession of the Said Apartment- Upon receiving a written intimation from the Promoter as per para 7.6.1, the Allottee shall take possession of the Said Apartment from the Promoter by executing necessary indemnities, receipts and such other documentation as prescribed in this Agreement, and the Promoter shall give possession of the Said Apartment to the Allottee. In case the Allottee fails to take possession within the time provided in para 7.6.2, such Allottee shall continue to be liable to pay maintenance charges as specified in para 7.6.1

Failure of Allottee to. take Possession possession of the Said Apartment- (Apartment): Upon receiving a written intimation from the Promoter (through email or speed post) as per para 7.6.1, 7.2 the Allottee allottee shall take possession of the Said Apartment from the Promoter by executing necessary indemnities, receipts undertaking and such other documentation as prescribed in this Agreement, and the Promoter shall give possession of the Said Apartment to the Allotteeallottee. In case the Allottee fails to take possession within the time provided in para 7.6.2, 7.2 such Allottee shall continue to be liable to pay maintenance charges as specified in para 7.6.17.2.

Failure of Allottee to. take Possession possession of the Said Apartment- Apartment/ Flat- Upon receiving a written intimation from the Promoter as per para 7.6.1Para 7.2, the Allottee Allottee(s) shall take possession of the Said Apartment Apartment/ Flat from the Promoter by executing necessary indemnities, receipts undertakings and such other documentation as prescribed in this Agreement, Agreement and the Promoter shall give possession of the Said Apartment Apartment/ Flat to the AllotteeAllottee(s). In case the Allottee Allottee(s) fails to take possession within the time provided in para 7.6.2Para 7.2, such Allottee shall continue to be liable to pay maintenance charges as specified in para 7.6.1under Para 7.2 above.

Failure of Allottee to. take Possession of the Said Apartment- Apartment - Upon receiving a written intimation from the Promoter as per para 7.6.17.2, the Allottee shall take possession of the Said Apartment from the Promoter by executing necessary indemnities, receipts undertakings and such other documentation as prescribed in this Agreement, and the Promoter shall give possession of the Said Apartment to the Allotteeallottee. In case the Allottee fails to take possession within the time provided in para 7.6.27.2, such Allottee shall continue to be liable to pay maintenance charges as specified in para 7.6.111.

Failure of Allottee to. take Possession possession of the Said Apartment- Apartment - Upon receiving a written intimation from the Promoter as per para 7.6.1mentioned in Clause 7.2 above, the Allottee shall take possession of the Said Apartment from the Promoter by executing necessary indemnities, receipts undertakings and such other documentation as prescribed in this Agreement, and the Promoter shall give possession of the Said Apartment to the Allottee. In case the Allottee fails to take possession within the time provided in para 7.6.2Clause 7.2 above, such Allottee shall continue to be liable to pay interest on amount due and payable in terms of this Agreement, maintenance charges as specified in para 7.6.1charges, municipal tax and

Failure of Allottee to. take Possession possession of the Said Designated Apartment- Upon receiving a written awritten intimation from the Promoter as per para 7.6.1Para 7.2, the Allottee Allottee(s) shall within the period mentioned in such intimation take possession of the Said Designated Apartment from the Promoter by executing necessary indemnities, receipts undertakings and such other documentation as prescribed in this Agreement, Agreement and the Promoter shall give possession of the Said Designated Apartment to the AllotteeAllottee(s). In case the Allottee Allottee(s) fails to take possession within the time provided in para 7.6.2, such Allottee shall continue to be liable to pay maintenance charges as specified in para 7.6.1take

Failure of Allottee to. take Possession of the Said Apartment- Apartment - Upon receiving a written intimation from the Promoter as per para 7.6.17.2, the Allottee shall take possession of the Said Apartment from the Promoter by executing necessary indemnities, receipts undertakings and such other documentation as prescribed in this Agreement, and the Promoter shall give possession of the Said Apartment to the Allotteeallottee. In case the Allottee fails to take possession within the time provided in para 7.6.2clause 7.2, such Allottee shall continue to be liable to pay maintenance charges as specified in para 7.6.1applicable.

Failure of Allottee to. take Possession of the Said Apartment- Apartment/Flat/Shop - Upon receiving a written intimation from the Promoter as per para 7.6.17.2, the Allottee shall take possession of the Said Apartment Apartment/Flat/Shop from the Promoter by executing necessary indemnities, receipts undertakings and such other documentation as prescribed in this Agreement, and the Promoter shall give possession of the Said Apartment Apartment/Flat/Shop to the Allottee. In case the Allottee fails to take possession within the time provided in para 7.6.27.2, such Allottee shall continue to be liable to pay maintenance charges as specified in para 7.6.17.2.

Failure of Allottee to. take Possession of the Said Apartment- [Apartment/Plot] - Upon receiving a written intimation from the Promoter as per para 7.6.17.2, the Allottee shall take possession of the Said Apartment from the Promoter by executing necessary indemnities, receipts undertakings and such other documentation as prescribed in this Agreement, and the Promoter shall give possession of the Said Apartment to the Allotteeallottee. In case the Allottee fails to take possession within the time provided in para 7.6.2, 7.2 such Allottee shall continue to be he liable to pay maintenance charges as specified in para 7.6.17.2.

Failure of Allottee to. take Possession possession of the Said Apartment- Apartment – Upon receiving a written intimation from the Promoter as per para 7.6.17.2, the Allottee shall take possession of the Said Apartment from the Promoter by executing necessary indemnities, receipts undertakings and such other documentation as prescribed in this Agreement, Agreement and the Promoter shall give possession of the Said Apartment to the Allottee. In case the Allottee fails to take possession within the time provided in para 7.6.2, 7.2 in the Possession Notice such Allottee shall continue to be liable to pay maintenance charges as specified in para 7.6.17.2 from such date as notified in the Possession Notice (Deemed Possession).

In case the Allottee fails to take possession within the time provided in para 7.6.2clause 7.2, such Allottee shall continue to be liable to pay maintenance charges as specified in para 7.6.1applicable. .
