Common use of Failure or Delay Clause in Contracts

No failure or delay on the part of Bank in the exercise of any power, right or privilege under this Agreement, the Note or the Collateral Documents shall operate as a waiver thereof, nor shall any single or partial exercise of any such power, right or privilege preclude other or further exercise of any other power, right or privilege.
