Common use of Failure or Delay Clause in Contracts

Failure or Delay. No failure or delay on the part of ---------------- the Agent or any Lender or any holder of any Note in the exercise of any power, right or remedy under this Agreement or the other Loan Documents shall impair such power, right or remedy or shall operate as a waiver thereof, nor shall any single or partial exercise of any such power, right or remedy preclude other or further exercise of any other power, right or remedy.
