Common use of Failure to Maintain Coverage Clause in Contracts

Failure to Maintain Coverage. Consultant agrees to suspend and cease all Services hereunder during such period of time as the required insurance coverage is not in effect and evidence of insurance has not been furnished to District. District shall have the right, but not the duty, to withhold any payment due Consultant until Consultant has fully complied with the insurance provisions of this Agreement, to obtain the insurance it deems necessary and any premium paid by District will be promptly reimbursed by Consultant or withheld by District from Consultant’s payments, or to terminate this Agreement for cause. If Consultant’s operations are suspended for failure to maintain required insurance coverage, Consultant shall not be entitled to an extension of time for completion of the Services because of production lost during suspension.
