Failure to Obtain or Maintain Coverage Sample Clauses

Failure to Obtain or Maintain Coverage. Applicant’s failure to obtain and maintain the required levels and types of insurance coverage required under this Agreement shall be grounds for termination of this Agreement and licenses subject to this Agreement. If an insurance carrier shall at any time notify Applicant or SWBT that any policy or policies of insurance required under this Agreement will be cancelled or changed in any manner which will result in Applicant’s failure to meet the requirements of this Agreement, SWBT may terminate this Agreement and all licenses subject to this Agreement not less than 60 days after giving Applicant written notice of its intention to do so, and such termination shall be effective on the termination date specified in the notice unless Applicant has obtained (or made arrangements satisfactory to SWBT to obtain) the required coverage from another source. In the alternative, SWBT may, in its sole discretion, elect to take such action as may be necessary to keep such policy in effect with the required coverages.
Failure to Obtain or Maintain Coverage. CLEC’s failure to obtain and maintain the required levels and types of insurance coverage required under this Appendix may be grounds for termination of this Appendix and licenses subject to policies of insurance required under this Appendix will be canceled or changed in any manner which will result in CLEC’s failure to meet the requirements of this Appendix, SBC MISSOURI may terminate this Appendix and all licenses subject to this Appendix not less than 60 days after giving CLEC written notice of its intention to do so, and such termination shall be effective on the termination date specified in the notice unless CLEC has obtained (or made arrangements satisfactory to SBC MISSOURI to obtain) the required coverage from another source. In the alternative, SBC MISSOURI may, in its sole discretion, elect to take such action as may be necessary to keep the policy in effect with the required coverages.
Failure to Obtain or Maintain Coverage. The failure by either Contractor or Owner to obtain or maintain the insurance required hereunder shall entitle the other Party, in addition to any other remedies available under this Agreement, at law or in equity, to obtain such coverage at the expense of the Party failing to obtain or maintain such insurance; provided, however, that such Party shall reimburse the other Party for the cost of obtaining or maintaining such insurance. ____________________________

Failure to Obtain or Maintain Coverage. AT&T’s failure to obtain and maintain the required levels and types of insurance coverage required under this Appendix may be grounds for termination of this Appendix and permits subject to policies of insurance required under this Appendix will be canceled or changed in any manner which will result in AT&T’s failure to meet the requirements of this Appendix, SBC NEVADA may terminate this Appendix and all permits subject to this Appendix not less than 60 days after giving AT&T written notice of its intention to do so, and such termination shall be effective on the termination date specified in the notice unless AT&T has obtained (or made arrangements satisfactory to SBC NEVADA to obtain) the required coverage from another source. In the alternative, SBC NEVADA may, in its sole discretion, elect to take such action as may be necessary to keep the policy in effect with the required coverages.

Related to Failure to Obtain or Maintain Coverage

  • Failure to Maintain Coverage Failure by the Contractor to maintain the required insurance, or to provide evidence of insurance coverage acceptable to the County, shall constitute a material breach of the Contract upon which the County may immediately terminate or suspend this Contract. The County, at its sole option, may obtain damages from the Contractor resulting from said breach. Alternatively, the County may purchase such required insurance coverage, and without further notice to the Contractor, the County may deduct from sums due to the Contractor any premium costs advanced by the County for such insurance.

  • Failure to Maintain Insurance Failure on the part of the Consultant to maintain the insurance as required shall constitute a material breach of agreement, upon which the City may, after giving five business days’ notice to the Consultant to correct the breach, immediately terminate the agreement or, at its discretion, procure or renew such insurance and pay any and all premiums in connection therewith, with any sums so expended to be repaid to the City on demand, or at the sole discretion of the City, offset against funds due the Consultant from the City.

  • Failure to Maintain If the Tenant fails to obtain and maintain Renters Insurance as required under this Agreement, it shall be considered a violation and result in default of this Agreement.

  • Failure to Pay Insurance If any Borrower fails to obtain insurance as hereinabove provided, or to keep the same in force, Agent, if Agent so elects, may obtain such insurance and pay the premium therefor on behalf of such Borrower, and charge Borrowers’ Account therefor as a Revolving Advance of a Domestic Rate Loan and such expenses so paid shall be part of the Obligations.
