Failure to Pay When Due. Should City fail to tender payment of any amount when due, interest thereon shall accrue at the rate of ten percent per annum from the date when due until paid. In the event City fails to timely tender payment of any amount within the 45-day period established in Section 3.02 hereof, and such failure continues for 45 days after notice to City of such default, City shall not allow any new, enlarged or expanded premises to be served by the City System until the default is cured. This is in addition to all other remedies provided in this Agreement, and limitations on remedies do not apply.
