Failure to Submit Financial Statements. In addition to any other remedies available to COUNTY at law or in equity or under this CONTRACT, in the event that CONTRACTOR fails to submit any financial statements by the due date listed in the clause of this CONTRACT entitled "RECORDS AND ACCOUNTS," COUNTY may require CONTRACTOR to submit the greater of: i. $5,000 fine; or ii. Any and all costs incurred by COUNTY for the CPA hired by the CONTRACTOR to prepare the required financial statements, including an administrative fee equal to fifteen percent (15%) of those costs.
