The Federal Provisions clause establishes requirements that ensure a contract complies with applicable federal laws, regulations, and policies. This clause typically applies to agreements involving federal funding or oversight, mandating adherence to standards such as equal employment opportunity, anti-discrimination, or environmental regulations. Its core function is to ensure that all parties fulfill federal obligations, thereby reducing legal risk and maintaining eligibility for federal support.
Federal Provisions. 2.1. The use of all federal funds paid under this Grant are subject to all applicable federal regulations, including the provisions described below. 2.2. Grantee must ensure that any further distribution or payment of the federal funds paid under this Grant by means of any contract, subgrant, or other agreement between Grantee and another party for the performance of any of the activities of this Grant, includes the requirement that such funds may be used solely in a manner that complies with the provisions of this Grant. 2.3. Grantee must include and incorporate the provisions described below in all contracts and subgrants that may use, in whole or in part, the funds provided by this Grant. 2.4. Grantee must comply, and ensure the compliance by subcontractors or subgrantees, with 41 U.S.C. 4712, Program for Enhancement of Employee Whistleblower Protection. Grantee must inform subrecipients, contractors and employees, in writing, in the predominant language of the workforce, of the employee whistleblower rights and protections under 41 USC § 4712. For purposes of these provisions, the following definitions apply:

With respect to any conflict between such Federal Requirements and the terms of this Agreement and/or the provisions of state law, the more stringent requirement shall control.
Federal Provisions. If this Agreement is federally funded in whole or in part, Contractor must comply with all applicable provisions of OMB Circular A-110. Further, if this Agreement is funded with American Recovery and Reinvestment Act (ARRA) funds or if Federal Funding Accountability and Transparency Act (FFATA) applies, Contractor is required to submit certain information to University. If Contractor fails to timely submit such required information, University reserves the right to cancel this Agreement or, if Deliverables have been provided and accepted, withhold payment until such required submittals have been received.
Federal Provisions. If federal funds (under a federal grant) are expended under this Agreement, CONTRACTOR shall comply with the applicable provisions of RCUH Attachment 32a (Terms and Conditions Applicable to Contracts/Subcontracts/Purchase Orders (Under Federal Grants)).

The Agency will agree to comply with all Federal statutes and implementing regulations relating to nondiscrimination concerning race, color, sex, religion, national origin, handicaps, and age. These include but are not limited to: (a) Title VI of the Civil Rights Act of 1964 (42 U.S.C. 2000d et seq., 78 stat. 252); (b) The Uniform Relocation Assistance and Real Property Acquisition Policies Act of 1970, (42 U.S.C. 4601) (c) Federal-Aid Highway Act of 1973, (23 U.S.C. 324 et seq.), and Title IX of the Education Amendments of 1972, as amended (20 U.S.C. 1681-1683 and 1685-1686); (d) Non-Discrimination in Federally-assisted programs of the United States Department of Transportation (e) Section 504 of the Rehabilitation Act of 1973, (29 U.S.C. 794 et seq.), as amended, and 49 CFR Part 27; and (f) The Age Discrimination Act of 1975, as amended (42 U.S.C. 6101 et seq.); (g) The Civil Rights Restoration Act of 1987, (Pub. L. 100-209); (h) Titles II and III of the Americans with Disabilities Act (42 U.S.C. 12131-12189) and 49 CFR parts 37 and 38; (i) Executive Order 12898, Federal Actions to Address Environmental Justice in Minority Populations and Low-Income Populations; (j) Executive Order 13166, Improving Access to Services for Persons with Limited English Proficiency
Federal Provisions. The following clauses apply to this Agreement unless California law imposes a more restrictive standard.
Federal Provisions. With respect to any conflict between such Federal Requirements and the terms of this Agreement and/or the provisions of state law, the more stringent requirement shall control.
Federal Provisions. CONTRACTOR shall comply with the provisions in Exhibit E to this Agreement. In the event of a conflict between any provision in Exhibit E and any other provision of this Agreement, the more stringent provision shall control and prevail.
