Common use of Fees, In General Clause in Contracts

Fees, In General. The City shall pay fees to the Consultant as specified in Article 4 for all services rendered by the Consultant in accordance with the terms and conditions of this Contract, but subject to Section 4.2 relating to appropriations made by the City. If the Consultant receives payment from the City for work performed by any subcontractor or for materials provided by any supplier, and the Consultant withholds payment to the subcontractor or supplier on account of a deficiency in the quality or quantity of the work or materials, the City may withhold a corresponding amount from any pending or future payments to the Consultant until the next regular payment to the Consultant occurring after the City receives reasonable documentation that the deficiency has been remedied.
