Common use of Filing Date Clause in Contracts

Filing Date. (A) If no Exchange Offer Registration Statement has been filed by the Issuers pursuant to this Agreement, August 24, 2006; and (B) in each other case (which may be applicable notwithstanding the consummation of the Exchange Offer), the 30th day after the delivery of a Shelf Notice.

Filing Date. (A) If no Exchange Offer Registration Statement has been filed by the Issuers pursuant to this Agreement, August 24January 13, 2006; and (B) in each other case (which may be applicable notwithstanding the consummation of the Exchange Offer), the 30th day after the delivery of a Shelf Notice.

Filing Date. (A) If no Exchange Offer Registration Statement has been filed by the Issuers Issuer pursuant to this Agreement, August 24, 2006the 45th day after the Issue Date; and (B) in each other case (which may be applicable notwithstanding the consummation of the Exchange Offer), the 30th day after the delivery of a Shelf Notice.

(A) If no Exchange Offer Registration Statement has been filed by the Issuers pursuant to this Agreement, August 24, 2006the 70th day after the Issue Date; and (B) in each other case (which may be applicable notwithstanding the consummation of the Exchange Offer)with respect to a Shelf Registration Statement, the 30th 70th day after the delivery of a Shelf NoticeNotice as required pursuant to Section 2(c) hereof.
