Common use of Final Design Phase Clause in Contracts

Final Design Phase. During the Final Design Phase, the CONSULTANT shall, if requested by the CITY and accepted by the CONSULTANT as part of a Services Authorization: 1.4.1 On the basis of the accepted Preliminary Design documents and the Total Project Cost estimate, prepare for incorporation in the Construction Contract Documents final drawings (Drawings) to show the general scope, extent and character of the work to be furnished and performed by the Project Contractor(s), and specifications (Specifications) (which will be prepared in conformance with the sixteen-division format of the Construction Specifications Institute). 1.4.2 Prepare and furnish to the CITY such documents and design data as may be required by the CITY, so that the CITY may apply for approvals of such governmental authorities as have jurisdiction over design criteria applicable to the Project. The CONSULTANT shall also assist the CITY in obtaining such approvals by submitting, participating and/or leading in negotiations with appropriate authorities, and the Services Authorization shall define the CONSULTANT's role in this regard. 1.4.3 In conjunction with furnishing the related drawings and specifications to the CITY, advise the CITY promptly, in writing, at the thirty percent (30%), sixty percent (60%), and ninety percent (90%) completion stages of any Project, of the estimated Project construction cost. 1.4.4 Advise the CITY of any significant adjustments to the latest Total Project Cost estimate caused by changes in Project extent or design requirements or by variations in construction costs and furnish a revised Total Project Cost estimate based on the latest drawings and specifications. 1.4.5 Prepare for review and approval by the CITY, Invitations For Bid, Bid Forms (where appropriate), Supplementary Conditions and assist in the preparation of other related documents. 1.4.6 Furnish number of copies as identified in the Services Authorization of the drawings and specifications and present and review them in person with the CITY.

Final Design Phase. During After written authorization to proceed with the Final Design Phase, the CONSULTANT Consultant shall, if requested by the CITY and accepted by the CONSULTANT as part of a Services Authorization: 1.4.1 1.4.1. Submit to Owner within 15 days following authorization to proceed, a Project Information Manual (PIM) for the Final Design Phase showing the timing for completing the various tasks and periodic meetings with Owner to review and coordinate the work, and including a detailed description of the resources to be provided and anticipated payment request schedule. Present the PIM at the initial meeting with Owner. 1.4.2. Provide additional field surveys and subsurface explorations required to complete the Final Design Phase. 1.4.3. On the basis of the accepted Preliminary Design documents and the revised opinion of probable Total Project Cost Costs (class 3 estimate), prepare for incorporation in the Construction Contract Documents final drawings (hereinafter called “Drawings) prepared in conformance with Owner’s current CAD Standards Manual and Exhibit E “Drawing Submittal Requirements” to show the general scope, extent and character of the work to be furnished and performed by the Project Contractor(s), Contractor; and specifications (Specifications) (which will be Specifications prepared in conformance with the sixteen-division format of Owner's current section format, page format, and wording style standards, which are based on the Construction Specifications Institute). 1.4.2 Prepare and furnish to the CITY such documents 1.4.4. Provide technical criteria, written descriptions and design data as may be required by the CITY, so that the CITY may apply for approvals Owner's use in filing applications for permits with or obtaining approval of such governmental authorities as have jurisdiction over to approve the design criteria applicable to of the Project. The CONSULTANT shall also , and assist the CITY Owner in obtaining such approvals by submitting, participating and/or leading in negotiations consultations with appropriate authorities, and the Services Authorization shall define the CONSULTANT's role in this regard. 1.4.3 In conjunction with furnishing the related drawings and specifications 1.4.5. At 60 percent design completion, furnish to the CITY, advise the CITY promptly, in writing, at the thirty percent Owner a revised opinion of probable Total Project Costs (30%class 2 estimate), sixty percent (60%), and ninety percent (90%) completion stages of any Project, of the estimated Project construction cost. 1.4.4 Advise the CITY of any significant adjustments to the latest Total Project Cost estimate caused by changes in Project extent or design requirements or by variations in construction costs and furnish a revised Total Project Cost estimate based on the latest drawings and specifications. 1.4.5 1.4.6. Prepare for review and approval by the CITYOwner, Invitations For Bidits legal counsel and other advisors contract agreement forms, Bid Forms general conditions, supplementary conditions, (where appropriateincluding identification of any reports or drawings regarding subsurface physical conditions utilized by Consultant in preparation of Contract Documents), Supplementary Conditions bid forms, invitations to bid and instructions to bidders (all in conformance with Owner's current standards), and assist in the preparation of other related documents. 1.4.6 1.4.7. Meet with Owner during the Final Design Phase at the times indicated in the PIM to review data, draft documents, and Drawings and to allow for Owner input. 1.4.8. Furnish the draft of the Final Design documents to Owner for review, meet with Owner to discuss comments, revise documents to include changes agreed upon, and submit final documents for Owner’s use and distribution. The number of copies as identified in the Services Authorization of the drawings draft and specifications final documents shall be as provided in Exhibit A "Further Description of Basic Engineering Services and present Related Matters." 1.4.9. Based on the Final Design documents, furnish to Owner a revised opinion of probable Total Project Costs (class 1 estimate). The duties and review them responsibilities of Consultant during the Final Design Phase are amended and supplemented as indicated in person with the CITYparagraph 4 of Exhibit A "Further Description of Basic Engineering Services and Related Matters."
