The "FINDING" clause establishes the official determination or conclusion reached by a court, arbitrator, or other decision-making body regarding the facts or issues in a case. In practice, this clause outlines the specific facts that have been established based on the evidence presented, and may detail which party's arguments or claims have been accepted or rejected. Its core function is to provide a clear and authoritative record of the factual basis for the decision, ensuring transparency and supporting any subsequent legal actions or appeals.
Finding. A Finding is defined as any Commission identified noncompliance with Agreement requirements that specifies that an activity or action did not take place. The Commission will document in writing any and all findings of noncompliance with this Agreement and will afford the CNA the opportunity to work with the Commission to address any such findings.
