Finding of No Adverse Effect. The Caltrans District may make a finding of “No Adverse Effect with Standard Conditions” when standard conditions that will avoid adverse effects to historic properties are imposed in accordance with Appendix 5 to this Agreement. The Caltrans District may propose a finding of “No Adverse Effect” if none of the undertaking’s anticipated effects meet the Criteria of Adverse Effect under 36 CFR § 800.5(a)(1), non-standard conditions are imposed to avoid adverse effects, or when the Caltrans District has developed a plan for managing any post- review discoveries, including decision thresholds and procedures for consultation with the SHPO, that would be implemented in accordance with Stipulation XV.
