Common use of FiveCom Representations Clause in Contracts

FiveCom Representations. FiveCom represents and warrants to BecoCom that it has the right, and the full corporate power and authority to execute and deliver this Agreement and to consummate the transactions contemplated hereby. The execution and delivery of this Agreement and the consummation of the transactions contemplated hereby by FiveCom have been duly and validly authorized by all necessary corporate action on the part of FiveCom. In addition, FiveCom represents and warrants to BecoCom that: (1) it owns or has secured the rights to use fiber optic cable in addition to the FiveCom Fibers specified herein necessary to complete the entire FiveCom Network; and
