Common use of Fixed Term Contracts Clause in Contracts

Fixed Term Contracts. Employees may be appointed on a fixed term contract, which means an engagement for a specified period of time, task or project, subject to the following: (a) Prior to the commencement of a fixed term contract, you will be advised in writing of your capacity (ie. full time or part time), your job classification, your Ordinary Rate of Pay and the period or nature of your fixed term contract; (b) If you are an employee on a fixed term contract, upon the cessation of the fixed term contract you will not be entitled to notice of termination (Clause 45). You will otherwise be entitled, on a pro-rata basis, to the same terms and conditions of employment as are provided to full time or part time employees under this Agreement, as the case may be; (c) Each fixed term contract (where you have been appointed for more than one specified period of time, task or project) stands alone and does not accumulate for the purposes of continuous service; and (d) The Employer and you may agree to extend the term of the fixed term contract during the life of the contract where there are extenuating circumstances affecting the operational requirements of the Employer’s business.
