Food Service Manager. 2. The staffing needs of the District shall determine which classifications are to be reduced. Affected employees shall receive thirty (30) days’ notice of layoff. 3. Employees in the affected classification who have received more than one (1) unsatisfactory evaluation(s) in the past three (3) years and have not shown improvement in the deficient areas shall be laid off first. Such employees are not subject to recall. 4. Once the above criteria are met, seniority shall determine the order of reduction with the least senior employee the first to be laid off in the affected classification. Seniority shall be defined as the total years of uninterrupted service to the District in any position now in the bargaining unit. Accumulation of seniority shall begin on the employee's first working day in the District. Part-time employees shall accrue seniority on a pro- rated basis. For the purposes of this article only, six (6) hours per day shall be considered full-time employment. Employees with less than six (6) hours a day shall accrue seniority at one half (½) the rate of full-time employees. Section 16.4 Laid off employees shall be recalled in reverse order of layoff to any open position within their classification. Notices of recall shall be sent certified to the last known address as shown on the employer's record. It shall be the employee's responsibility to keep the employer informed of their current address. The employee shall have ten (10) calendar days to respond to the notice of recall. An employee who declines recall to perform work for which they are qualified, shall forfeit all rights under this Article, provided, however, former full-time employees who are offered part-time work may decline without loss of their recall rights. Also, a former part-time employee may refuse an offer of full-time employment without loss of recall rights. Section 16.5 Employees shall be eligible for recall up to eighteen (18) months following their last date of employment. Recalled employees shall retain their previously accrued benefits such as sick leave and seniority.
