Common use of For the Premises Clause in Contracts

For the Premises. (a) Landlord shall maintain and operate the heating, ventilating and air conditioning systems used for the Permitted Use only (“HVAC”); provided that Tenant shall maintain the heat pumps and any split systems for information technology or other lab equipment, and (b) subject to Subsection 16.9(a), Landlord shall furnish HVAC as reasonably required (except as this Lease otherwise provides) for reasonably comfortable occupancy of the Premises twenty-four (24) hours a day, every day during the Term, subject to casualty, eminent domain or as otherwise specified in this Article. Notwithstanding anything to the contrary in this Section, Landlord shall have no liability, and Tenant shall have no right or remedy, on account of any interruption or impairment in HVAC services; provided that Landlord shall use commercially reasonable efforts to advise Tenant in advance of any expected stoppage of service to the Premises and diligently endeavors to cure any such interruption or impairment.
