Form of Orders. 4.4.1 Notwithstanding that an Order may not refer to this Agreement, any Order issued by the Customer during the Term shall be deemed to have been issued pursuant to this Agreement and shall be governed by the terms and conditions of this Agreement, unless the parties expressly agree to the contrary in writing. 4.4.2 Preprinted terms or conditions on the applicable order shall be deemed deleted and of no force or effect and shall not provide the basis for non-acceptance by the Supplier of any Order.
