The Village Administrator* shall meet with immediately notify the grievor(s) and/or aggrieved employee, the representative(s) immediate supervisor of such aggrieved employee, and any other person previously rendering a determination in the subject matter of the grievance and shall require each of them to submit written statements to him/her within ten (10) Business Days from days setting forth the receipt specific nature of the grievances, all the facts relating thereto, the determination or determinations previously rendered, and the aggrieved employee’s reasons for being dissatisfied with such determination or determinations. Copies of such written statements shall be made available to the aggrieved employees.
ii. Upon request of any party to a grievance, the Village Administrator* may notify all concerned in the subject matter of the grievance, of the time and place when a formal hearing will be held where such persons may appear and present oral and written statements supplementing their position in the case. The Village and CSEA shall bear equally the costs of such arbitration proceedings, exclusive of attorney’s fees. Formal Stage. a. Step 1One - Administrative Review
a) Failing i. If a satisfactory settlement in problem is not settled at the Informal Stage OECTA and the grievant wishes to proceed to the formal grievance stage the grievant shall commit obtain a grievance form from the Vice President of Human Resources and Development and shall submit the grievance in writing within forty-five (45) calendar days following the time at which the grievant(s) knew or ought to writing, setting out the facts have known of the grievance together with the provisions existence of the Agreement claimed to have been violated and indicating the relief sought. The grievance shall be signed by the grievor(s) and/or OECTA as the case may be and shall send the same to the senior administrator responsible for human resources or his designate within twenty (20) Business Days from the time of the occurrence of the circumstances situation giving rise to the grievance or when as demonstrated by appropriate documentation.
ii. The formal written grievance form shall state the Teacher ought reasonably to have become aware nature of the circumstances giving rise grievance, the remedy sought, and the agreed method of communication and shall be signed and dated by the grievant. The Vice President of Human Resources and Development will assist, if asked, with the preparation of the grievance and/or will explain the grievance process. The Vice President of Human Resources and Development shall maintain a confidential grievance case file containing all written materials and correspondence related to each grievance filed.
iii. The written grievance shall be filed by the grievant with the Vice President of Human Resources and Development who will distribute copies of the grievance to the grievance under this collective agreementPresident of the Association, the President of the University and other appropriate administrator(s).
b) iv. The senior administrator responsible for human resources or his/her designate, Vice President of Human Resources and Development shall meet arrange and attend a meeting with the grievor(sgrievant(s) and/or and the representative(snext level administrator above the person whose action or decision is being grieved and other administrator(s) as appropriate in whose area of responsibility the grievance applies. Such initial meeting will be scheduled within ten (10) Business Days from calendar days and held not more than twenty calendar ( 20) days of the receipt of the grievance. The senior next level administrator responsible for human resources or his designate shall forward the provide a written decision to OECTA within five (5) Business Days of such meeting.
a) Failing settlement at Step 1, the grievor(s) and/or OECTA shall submit the grievance, in writing, response pertaining to the Assistant Superintendent – Business Services or designate within five (5grievance which shall be forwarded to the grievant(s) Business Days and the Vice President of receiving the decision at Step 1.
b) The Assistant Superintendent – Business Services shall meet with the grievor(s) and/or OECTA representative(s) Human Resources and Development within ten (10) Business Days from calendar days after the receipt meeting(s). When the next level administrator is the University President then the grievant and the Vice President of Human Resources and Development may mutually agree to request an informal meeting with the President to determine if a satisfactory resolution of the grievancegrievance can be achieved. The senior administrator responsible for human resources However, the grievant and the Vice President of Human Resources and Development may otherwise agree to by-pass this informal meeting and then the grievance would proceed to Step Two.
v. If the person whose action or designate decision is being grieved is the University President, the grievance shall move to Step Two of the grievance procedure.
b. Step Two - University Human Resource Committee (UHRC) Review
i. If the grievance is not settled at Step One, the grievant(s) may be present if so required the grievance at Step Two by the Assistant Superintendent – Business Services. The Assistant Superintendent – Business Services or designate shall forward filing a written decision to OECTA within five (5) Business Days appeal with the Vice President of such meeting. If no settlement is reached, OECTA may submit the grievance to arbitration Human Resources and Development within ten (10) Business Days calendar days of receipt of the response at Step One.
ii. The Vice President of Human Resources and Development or his/her designee will forward within ten (10) calendar days of receipt of the appeal a copy of the appeal and all relevant information regarding the grievance to the Chairperson of the UHRC. In the absence of a named Chairperson, the Vice President of Human Resources and Development shall appoint a Convener.
iii. The Chairperson (or Convener) of the UHRC shall call an initial meeting with the grievant(s) and the UHRC. Such initial meeting shall be held within fourteen (14) calendar days of the UHRC receipt of the appeal. UHRC members are expected to be available to hear grievance appeals in a timely fashion.
iv. The Chairperson of UHRC will conduct the appeal proceedings and keep notes and records. The Chairperson of UHRC shall provide the written committee findings and recommendations pertaining to the appeal which shall be forwarded to the grievant(s), the Vice President of Human Resources and Development, the appropriate Administrator(s), the President of the Association and the President of the University. The committee is free to confer with all interested persons including the President or his/her designee, and the grievant(s) or the grievant’s(s’) designee prior to finalizing its findings and recommendations.
v. The University President will accept or reject the findings of the UHRC within fourteen (14) calendar days after receiving them and will notify the grievant(s), the Chairperson of the UHRC, the Vice President of Human Resources and Development, the appropriate Administrator(s) and the President of the Association of his/her decision and rationale. Prior to coming to a decision the President may, at his/her option, consult with any interested parties.
vi. If the findings and recommendations of the UHRC are in favor of the grievant(s) and support the remedy sought by the grievant and the President accepts the findings and recommendations of the UHRC, the grievant is precluded from taking further action and the grievance is final.
vii. If the President rejects the findings and recommendations of UHRC he/she may propose a modification and/or settlement which if accepted by the grievant, precludes the grievant from taking further action and the grievance is final.
viii. Upon acceptance by the President of the UHRC findings and recommendation as follows:called for in Article ▇▇.▇.▇.▇.▇▇, or upon acceptance by the grievant(s) of a modification and/or settlement the resolution shall be implemented as soon as practicably possible.
